A formidable challenge to the research of non-verbal behavior can be in the assumptions that we sometimes make, and the subsequent questions that arise from those assumptions. In this article, we proceed with an investigation that would have been precluded by the assumption of a 1:1 correspondence between facial expressions and discrete emotional experiences. We investigated two expressions that in the normative sense are considered negative expressions. One expression, “anger” could be described as clenched fists, furrowed brows, tense jaws and (...) lips, the showing of teeth, and flared nostrils, and the other “sadness” could be described as downward turned mouths, tears, drooping eyes, and wrinkled foreheads. Here, we investigated the prevalence, understanding, and use of these expressions in both positive and negative contexts in South Korea and the United States. We found evidence in both cultures, that anger and sadness displays are used to express positive emotions, a notion relevant to Dimorphous Theory. Moreover, we found that anger and sadness expressions communicated appetitive feelings of wanting to “go!” and consummatory feelings of wanting to “pause,” respectively. There were moderations of our effects consistent with past work in Affect Valuation Theory and Display Rule Theory. We discuss our findings, their theoretical relevance, and how the assumptions that are made can narrow the questions that we ask in the field on non-verbal behavior. (shrink)

Juridical councils that render rulings on bioethical issues for Muslims living in non-Muslim lands may have limited familiarity with the foundational concept of wilāyah (authority and governance) and its implications for their authority and functioning. This paper delineates a Sunni Māturīdi perspective on the concept of wilāyah, describes how levels of wilāyah correlate to levels of responsibility and enforceability, and describes the implications of wilāyah when applied to Islamic bioethical decision making. Muslim health practitioners and patients living in the absence (...) of political wilāyah may be tempted to apply pragmatic and context-focused approaches to address bioethical dilemmas without a full appreciation of significant implications in the afterlife. Academic wilāyah requires believers to seek authentication of uncertain actions through scholarly opinions. Fulfilling this academic obligation naturally leads to additional mutually beneficial discussions between Islamic scholars, healthcare professionals, and patients. Furthermore, an understanding derived from a Māturīdi perspective provides a framework for Islamic scholars and Muslim health care professionals to generate original contributions to mainstream bioethics and public policy discussions. A recent initiative at Muffakham Jah College of Engineering and Technology, Hyderabad, India, has resulted in setting up a program called Centre for Environment Studies and Socioresponsive Engineering which seeks to involve undergraduate students in studying and solving environmental problems in and around the city of Hyderabad, India. Two pilot projects have been undertaken — one focusing on design and construction of an eco-friendly house, The Natural House, and another directed at improving environmental and general living conditions in a slum (...) area. The paper describes our attempts and experience of motivating our students to take interest in such projects. In an interesting development we invited a member of a student-faculty team at Massachusetts Institute of Technology (M.I.T.) that is doing a project in Nepal on safe drinking water. We report in our paper how the presentation by the guest from M.I.T. served as a catalyst for generating interest among civil and mechanical engineering students in our own projects. The paper includes contributions from one of our students and the M.I.T. staff member, reporting on their experiences related to the slum development project. (shrink)

Centuries after his death, al-Ghazali remains one of the most influential figures of the Islamic intellectual tradition. Although he is best known for his _Incoherence of the Philosophers_, _Moderation in Belief_ is his most profound work of philosophical theology. In it_,_ he offers what scholars consider to be the best defense of the Ash'arite school of Islamic theology that gained acceptance within orthodox Sunni theology in the twelfth century, though he also diverges from Ash'arism with his more rationalist approach to (...) the _Quran_. Together with _The Incoherence of the Philosophers_, _Moderation in Belief_ informs many subsequent theological debates, and its influence extends beyond the Islamic tradition, informing broader questions within Western philosophical and theological thought. The first complete English-language edition of _Moderation in Belief_, this new annotated translation by Aladdin M. Yaqub draws on the most esteemed critical editions of the Arabic texts and offers detailed commentary that analyzes and reconstructs the arguments found in the work’s four treatises. Explanations of the historical and intellectual background of the texts also enable readers with a limited knowledge of classical Arabic to fully explore al-Ghazali and this foundational text for the first time. With the recent resurgence of interest in Islamic philosophy and the conflict between philosophy and religion, this new translation will be a welcome addition to the scholarship. (shrink)

Abortion is forbidden under normal circumstances by nearly all the major world religions. Traditionally, abortion was not deemed permissible by Muslim scholars. Shiite scholars considered it forbidden after implantation of the fertilised ovum. However, Sunni scholars have held various opinions on the matter, but all agreed that after 4 months gestation abortion was not permitted. In addition, classical Islamic scholarship had only considered threats to maternal health as a reason for therapeutic abortion. Recently, scholars have begun to consider the effect (...) of severe fetal deformities on the mother, the families and society. This has led some scholars to reconsider the prohibition on abortion in limited circumstances. This article reviews the Islamic basis for the prohibition of abortion and the reasons for its justification. Contemporary rulings from leading Shiite scholars and from the Sunni school of thought are presented and reviewed. The status of abortion in Muslim countries is reviewed, with special emphasis on the therapeutic abortion law passed by the Iranian Parliament in 2003. This law approved therapeutic abortion before 16 weeks of gestation under limited circumstances, including medical conditions related to fetal and maternal health. Recent measures in Iran provide an opportunity for the Muslim scholars in other countries to review their traditional stance on abortion. (shrink)

The main evidence used in a matter of proving prophethood in Kalām is miracles. For this reason, other extraordinary situations that miraculously occur have always been on the agenda of theologians. Of these the most similar to miracle is karāma events that occur extraordinary in the hands of Walī. Karāma has been discussed on certain theoretical grounds in kalām books during the beginning period of Sunnī kalām. As in other theological debates, the leading adversaries of Sunnī theologians in the issue (...) of karāma were Muʿtazilite theologians. This study discusses approaches towards karāma in early period of Sunnī kalām. Accordingly, the scholars who determined the basic approaches of Ashʿariyya and Māturīdiyya kalām schools are included in the study. İmām al-Ashʿarī, Ibn Fūrak, al-Bāqillānī, ʿAbd al-Qāhir al-Baghdādī, Abu’l-Maʿālī İmām al-ḥaramayn al-Juwaynī, Abū ʿAbdallāh al-Ḥalīmī and Abū Isḥāq al-Isfarāyīnī from Ashʿarī school; Abū Manṣūr al-Māturīdī, Ḥakīm as-Samarqandī, Abū al-Yusr al-Bazdawī and Abū al-Muīn an-Nasafī from Māturīdiyya school, in this context, are included in the study. Besides, some authors from fields other than kalām are included in the scope of the study in order to determine the first use of the concept of karāma and different approaches are discussed. Benzer biçimde İran – Suudi Arabistan rekabetinin içindeki kimlik politikaları üzerine yazılmış literatürün büyük bir kısmı bölgesel istikrarsızlıkların kökeni ve kaynağını ağırlıklı olarak tarihlerinin genel ve betimleyici bir hesabını sunmuş veya oyuncuların iktidar mücadeleleri içerisinde Sünni ve Şii İslam’ın politikleşmesine ve manipülasyonuna odaklanmıştır. Feelings of guilt are human emotions that may arise if a person committed an action that contradicts basic moral mores or failed to commit an action that is considered moral according to their ethical standards and values. Psychological scholarship distinguishes between altruistic guilt (AG) and deontological guilt (DG). AG results from having caused harm to an innocent victim, either by acting or failing to act, whereas DG is caused by violating a moral principle. Although physicians may be expected to experience (...) frequent feelings of guilt in their demanding and intensive work, it is surprising to find that this issue has not been explored in the professional literature on medical ethics. To that end, we conducted a qualitative study that included personal in-depth interviews with Sunni Muslim gynaecologists. These doctors provide underground infertility care and perform religiously forbidden treatments involving sex selection and gamete donation. They opened their hearts and spoke about the emotionally taxing pangs of conscience they suffer. Analysing their narratives led us to characterize their feelings of guilt as DG. We discuss the causes for their plight and the way they cope with it, compare DG to the concept of moral distress, and call for future research on clinicians’ feelings of guilt and pangs of conscience. İslam inancının “aslü’l-usûlü”nü teşkil eden ilâhiyât bahsi, kelâm ilminin en önemli ve karmaşık konularındandır. İlk dönemlerden itibaren Allah’ın zatı, sıfatları ve fiilleri başta olmak üzere ulûhiyet meselelerine dair farklı görüşler ileri sürülmüş ve mühim düşünce ayrılıkları ortaya çıkmıştır. Sünnî kelâmı tesis edenlerden biri olan Ebû Mansûr el-Mâtürîdî de ilâhiyât alanına giren bu hususlarda geniş bir perspektifle özgün fikirler ortaya koymuştur. Mâtürîdî, Allah’ın zâtı ve sıfatları alanına giren mevzularda büyük ölçüde nakle bağlı kalmış, te’vilde bulunması gerektiğinde de özellikle “Allah’tan teşbihin nefyi” (...) hususuna ayrı bir önem vermiştir. O, Allah’ın evrendeki tasarruflarını ifade eden ilahî fiiller konusunda ise sık sık ilahî hikmete vurguda bulunmuş ve Allah’ın kâinatı yaratma amacı gibi insan idrakini aşan hususlarda mutlaka derin ilahî hikmetlerin bulunduğunu bilmemiz gerektiğini belirtmiştir. Bu çalışmada ulûhiyet meselelerinden olan rü’yetullah, Allah’ın arşa istivâsı, Allah’ın kâinatı yaratma amacı, Allah’ın zararlı nesneleri ve şerri yaratmasının hikmeti ve Allah’ın mekânla sınırlandırılamayacağı konularına dair İmam Mâtürîdî’nin yaklaşımlarına yer verilecektir. Muhammed Kâsım Nânotevî başkanlığında kurulan Diyobendîlerin ta-savvuf ile irtibatını konu edinen bu çalışmanın temel amacı, Hint alt kıtasının dinî yaşantısında etkin olan Diyobendîlerin tasavvufa olan yaklaşımlarını analiz etmektir. Çalışmada öncelikle Diyobend’in kuruluşu, İngilizlere karşı mücadeleleri, Osmanlı Devleti ile temasları ve daha sonra Diyobendîlerin tasavvuf anlayışına dâir bilgilere yer verilmiştir. Onların tasavvuf ile ilişkileri araştırılırken literatür açısından Diyobendîler ile ilgili temel kaynaklara bakılmıştır. Bu kaynaklar geniş bir incelemeye tabi tutularak onların tasavvufa bakış açıları tespit edilmeye çalışılmıştır. Elde edilen sonuçlar kısaca şöyle (...) özetlenebilir: Sünnî olan Diyobendîler tasavvufu şerîatın bir parçası olarak görmektedirler. Onlar, mânevî hastalıklardan korunmak için tasavvufa sarılmaya, mürşidlerin sünnete ittibasına ve bid’atlardan uzak durmaya önem vermiş, ayrıca nübüvvetin velâyetten üstün olduğunu, kerâmetin hak olduğunu ve vahdet-i vücûdun tasavvufun esaslarından biri olmayıp bunun bir hâl olduğunu ifade etmişlerdir. Bu çalışmada İmam Mâlik’in/Mâlikîlerin necasetler ve kadınların özel halleriyle ilgili üç sünni mezhep başta olmak üzere cumhura muhalefet ettiği ve bu mezhebin karakteristiği haline gelen bazı temel meselelerden yola çıkılarak onların Hicaz bölgesi kaynaklı bir mezhep olarak eser çizgisinde mi rey çizgisinde mi yahut bu iki arasında olup esere mi daha yakın olduğu ihtimallerini ortaya koymak amaçlanmıştır. Bu noktada Mâlikîlerin ve diğer mezheplerin muteber klasik kaynakları ile “ihtilâfu’l-fukahâ” türünden eserlere müracaat edilmiştir. Ele alınan örneklerde Mâlikîlerin görüşleri şöyledir: Suların pislenmesi konusunda (...) Mâlikîler suyun azlık ya da çokluk ölçüsünü değil suyun rengi, tadı ve kokusu gibi temel vasıflarından birinin değişip değişmediğini esas alarak hüküm vermişlerdir. Eti yenen hayvanların idrar ve dışkıları konusunda eti yenen hayvan necis bir şeyler yeyip içmemişse bunların hem idrarları hem de dışkılarının temiz olup, namaza engel olmadığı görüşünü benimsemişlerdir. Köpeğin kendisinin ve yaladığı kabın temiz olup olmadığı konusunda Mâlikîler köpek ve domuz dahil canlı olan her hayvan -necis bir şey yemiş olsa bile- temiz olduğu görüşünü savunmuşlardır. Hayzın herhangi bir alt sınırının olup-olmadığı noktasında bunun alt bir sınırının olmadığı ve bir defalık kanama yani kısa bir müddet kanın gelmesinin âdetin sübutu için yeterli olduğunu görüşünü benimsemişlerdir. Âdetli kadının Kur’an okuması meselesinde ise bu durumda olan kadının Kur’an’a dokunmasının yasak olduğu, fakat onu dokunmadan okuyabileceği görüşünde olmuşlardır. Hatta öğretici veya öğrenci olanlar zaruret miktarınca eğitim amacıyla ruhsat hükümden faydalanarak Kur’ân’a hem dokunabilir hem de onu okuyabilir. continent. 1.2 (2011): 129-135. Introduction Vincent W.J. van Gerven Oei Successions of words are so agreeable. It is about this. —Gertrude Stein Nachoem Wijnberg (1961) is a Dutch poet and novelist. He also a professor of cultural entrepreneurship and management at the Business School of the University of Amsterdam. Since 1989, he has published thirteen volumes of poetry and four novels, which, in my opinion mark a high point in Dutch contemporary literature. His novels even more than his poetry are (...) criticized for being inaccessible, which I generally take to be a compliment. It would be like saying that Fernando Pessoa is inaccessible, which he is not. Neither is Wijnberg. When we think of the combination economist-poet we are immediately reminded of the American poet Wallace Stevens, who, as the story goes, had two stacks of paper on his desk, one for contracts, one for poems. We also know that Stevens wrote on the economy and that questions of economy and insurance surface at multiple points in his poems. The following text is a very preliminary attempt to point at the intersections between poems, novels, business, and poetry in Wijnberg’s work. On the back cover of his novel De opvolging ( The Succession , 2005), Wijnberg states the following: “[This is] a novel for whomever is interested in the workings of a company as much as in the workings of a poem.” Wijnberg thus claims that the way in which a company “works” may be similar to the way in which a poem “works.” The question is the obvious one, what does this similarity consist in? De opvolging tells the story of company in which bosses and company doctors, secretaries, children, clowns, and beggars have tons of meetings, recite poems, perform plays, tell jokes, and succeed each other, climbing up and down in the company’s hierarchy. De opvolging is a novel in which the career of people follows the career of words. It resonates with Gertrude Stein's sentences, "Grammar. What is it. Who was it" (1975, 50). The words in Wijnberg's poems are like he characters in his novel. And if we keep in mind this allegorical reading of De opvolging , which is obviously only one of the possible readings, we may be able to understand some aspects of Wijnberg’s poetry. A repetition is already a pun. Look, that word is trying it again, as if it is afraid that by not doing it it would give up the hope that it will ever be able to do something. A pun is the opposite of the first word coming to the mind of someone who shouts it when he suddenly discovers something. (104) The repetition, the succession of the same word, is already a pun, a joke. The succession of the father by the son after the revolution is a joke. "Look he's trying it again!" The essence of a joke is a repetition. Archimedes’ “Eureka!” is its opposite. Poems can easily become jokes, depending on the way the words follow and repeat each other. In De opvolging , the careers of the bosses, good and bad secretaries, and company doctors easily become jokes, as they are “afraid that by not doing it [they] would give up the hope that [they] will ever be able to do something.” Not only the repetition, but also the distance and difference between the words in a poem, their cause and effect relations can be read as company relations. This becomes clear when we, for example, read the first lines of the poem “Cause, sign” from Het leven van ( The Life Of , 2009). A sign lets know what is going to happen, a cause lets it happen. If the sign also lets happen there is no reason to isolate it, because then I would isolate some- thing only because it’s different for me. If I didn’t have to write this myself, but would have secretaries to whom I could dictate it, I would be able to say more about it. (49) Upon reading the first two lines we can already conclude that any word may be cause or sign or both. If a sign is also a cause there is no reason to discriminate it, yet to the poet they are still different. This difference only becomes expressible the moment he would have a secretary. Just like in De opvolging , the secretary introduces a distance; not in a company but in a poem. Hence the difference between “good” and “bad” secretaries in a company, where the good secretary of one boss may be the bad secretary of another one. The more we can say about the bosses of the company, or signifiers of the poem, the greater the distance we introduce between them and us. We should take serious the relation between Wijnberg’s novels and poems. Although they operate on different scales, they explain and converse with each other. Another example may be the novel Politiek en liefde ( Politics and Love , 2002), which deals with the relation, precisely, between politics and love. In the novel, Nicolai, a lieutenant in the Dutch army, is sent to Africa on a military mission. Upon leaving a receives a letter from his father. Dear son, Don’t do anything stupid before your father has advised you to do so. Your mother asked me to write a wise letter. I have been looking for wisdom for half a day and haven’t found much. If you borrow a small amount from a bank you become the bank’s slave, but if you borrow a couple of millions and spend them as quickly as possible the bank becomes your slave. What I want to say is that you have to return from Africa in good health, and before you know it the world will be your slave [....] Signed with a kiss from your father. (88) The line, “If you borrow a small amount from a bank you become the bank’s slave, but if you borrow a couple of millions and spend them as quickly as possible the bank becomes your slave,” returns as the title of poem in Het leven van: “If I borrow enough money the bank becomes my slave” (12-3), which elaborates this theme. So both in the way that these poems are structured and in their subject matter, they refer to the structures of our economy, to the ever-continuing line of CEOs succeeding each other like words, to the distance between them introduced by bureaucracy, and giving and receiving as economical and poetical acts. Poem and economy map onto each other, as in another episode from De opvolging : Edward reads two of the beggar’s poems about presents. Of a holiday nothing remains, except for memories, and if some of them are bad I’d rather forget them all; if I get a present I’d rather get something that’s useful to me for a long time. If I may choose, I choose what I can use longest, long enough to partially forget that this was the present, because it feels bad when nothing is left of it. […] Giving away becomes destruction in the stock destruction economy [ voorraadvernie -tigings-economie ], that is a gift economy [ geschenkeneconomie ], encountering for the first time an economy in which there’s selling and buying on markets. Instead of destroying supplies someone can also quickly say that they aren’t worth anything anymore; if someone wants to take them I’d gladly give him something extra. In a stock destruction economy he is someone who each day wants to work more hours than his colleagues. If around a company there is a gift economy in which someone’s rank is determined and made visible by the gifts someone can give someone else, a company will be more often character- ized by an invisible or unclear system of ranks. (152) Two poems about gifts present two different economical models, described by Wijnberg with the terms “stock destruction economy” and “gift economy.” Here we immediately recall the opposition introduced by George Bataille’s work on the concept of expenditure in The Accursed Share , where a “general economy” would surpass the stock destruction economy based on scarcity (capitalism) and become a gift economy (potlatch) and an egalitarian (communist) society. These claims are made both on the level of the poems and in their discursive explanation. They follow each other and on each other. I would like to finish this introduction to Wijnberg’s writing with a translation from his novel De joden ( The Jews , 1999), which develops the story of Hitler abdicating as chancellor of the Third Reich, appointing philosopher Martin Heidegger as his successor. In a conversation with two Russian actor-spies, sent by Stalin to figure out the situation, philosopher Walter Benjamin describes the abdication scene. Maimon: You were there when Hitler resigned? Benjamin: In the room we’re right now. The desk and the chairs are new. After his resignation Hitler would like to take his furniture to his new house. Martin naturally agrees. It is a sunny day. Martin is very nervous and complains about the heat. Martin is wearing his best dark blue suit, not his professor’s robe. Hitler is wearing his uniform. We enter the room and Hitler gets up and embraces Martin. Martin is not very good at embracing. Hitler shakes his hand. Hitler’s cap is on the desk. The cap has a metal lining. Hitler has strong neck muscles. Hitler says: A man is unclean. He takes a bath. Does he make the bath water unclean? I say: a man is unclean. He steps into a river. A little further a man steps into the river; does he become unclean? Hitler nods. I say: a man is standing in music. Another man hears the music but also sees the first man moving on the beat of the music in a way that he is certain that the music would excite different feelings in him if he wouldn’t to see the first man. Hitler says: a man is clean, listens to music, is suddenly touched and he doesn’t know by what. The conversation ends in the way you know it ends. Hitler picks up his cap from the desk and puts it on Martin’s head. (73-4) Aware of the never ending debate on the question of Heidegger’s involvement in the Nazi regime, Wijnberg has the audacity to present the arguments of complicity in the religious terminology of cleanliness and uncleanliness, while at the same time recalling overtones of Hitler’s supposed love for Wagner, suggesting a relation between Benjamin and Hitler, and so on. The space of this introduction is to small to treat a novel like De joden , a reading of which together with passages from Philippe Lacoue-Labarthe's Heidegger, Art, and Politics: The Fiction of the Political , Jacques Derrida's Of Spirit , Christopher Fynsk's Heidegger: Thought and Historicity , and Avital Ronell's The Telephone Book would be extremely elucidating and potentially open new avenues in thinking Heidegger's emphasis on poetry after the fall of the Nazi empire. But at this point we will have to curb our curiosity and follow the poet himself. The themes of the relation between business and poetry, but also Chinese landscape painting, love, Indian and Japanese poetry, and Western philosophy are analyzed and assimilated in Wijnberg’s work without ever losing the clarity of expression. It may be that, according to Alain Badiou, the “Age of the Poets” is over, but its end (Paul Celan) has exactly brought a new balance between philosophy and poetry, and it is this playful, but nonetheless serious balance that makes one hope that one day Wijnberg’s complete oeuvre might become available to readers across the planet. Give me something that I can cancel against then I can prepare myself for it. The reward is that I may continue with what I’m doing, it doesn’t matter how long it takes. This has nothing to do with everything remaining the same if I say that I no longer want anything else. I wouldn’t be able to say in which one and the other occur in a way that I if I knew something to cancel that one against it wouldn’t be possible now. The stars above my head and being able to say what belongs to what if I’ve let them in. FOLLOWING MY HEART WITHOUT BREAKING THE RULES Observing the rules without observing the rules by going where the rules no longer apply. I could also observe the rules there by applying them to what at great distance may resemble what the rules are about. But why would I do that, not to confuse someone who is seeing me from a great distance? Behind this morning the morning prepares itself when the rules are everything I have. IF I BORROW ENOUGH MONEY THE BANK BECOMES MY SLAVE A bank lends me money, if I don’t pay it back they tell my boss that he has to pay them my salary. But they have to leave me enough to eat and sleep and an umbrella when it’s raining. They can also empty my house, the furniture isn’t worth a lot, but every little helps. Each morning I leave for work, if I don’t start early they’ll soon get someone else, no bank will lend me money when the sun is shining. My boss has given me a cat to raise as a dog. Of course I know that it won’t work out, but I’ve asked for a week—maybe the cat gets lucky, maybe I get lucky. My hands around a cup of coffee, before I leave for work, warm-empty, cold-empty, as if hidden in the mist over a lawn. What I make when there’s no work left for me, I’m ashamed to say how little it is. Once I’m outside I check it, if they watch out of the window they can see me doing it. Suppose it is so much that I’d stay counting for hours, it’s getting dark and I’m still there. They stay watching for a while once they’ve finished their work, but have to go home, I get that, sure, I could also go home and continue counting there. If it’s too little running back immediately won’t help, because nobody’s there anymore, and if I come back tomorrow I may have spent what’s missing tonight. Going somewhere where it’s warm enough to walk around without clothes during daytime, it helps me to know that something’s more there than here. For someone like me there’s work anywhere, it shouldn’t take a week to find work for me there. Three times work and a home close to work, I may choose one and try for a week whether I want to stay there. If at the end of the week I don’t want to stay I’m back on the next day, then it was a week’s holiday. RULES If that’s against a rule, it’s yet another one that I cannot observe, or only so briefly that I cannot re- member it later. Anyways the rules are only there to help me remember what I need in order to do better what I do. In that respect there’s no difference between the rules that I find in a book and the rules that I think of early in the morning. I know that because I’ve made a rule just now nothing has yet to observe it. CAUSE, SIGN A sign lets know what is going to happen, a cause lets it happen. If the sign also lets happen there is no reason to isolate it, because then I would isolate something only because it’s different for me. If I didn’t have to write this down myself, but would have secretaries to whom I could dictate it, I could to say more about it. If something is taken away from me I consider how it would be if the opposite had been taken from me. İlk dönem İslâm fırkalarından biri olan İbâziyye, Türkiye’de İslâm mezhepleri tarihi başta olmak üzere kelâm, hadis, tefsir, fıkıh gibi bilim dalları kapsamında incelenmiş ve önemli akademik araştırmalara konu olmuştur. Cumhuriyet döneminde İbâziyye fırkasına dair yapılan akademik araştırmalar bilhassa yirmi birinci yüzyılda hızlı bir artış göstermiştir. Bu çalışmada İslâm mezhepleri tarihi alanı başta olmak üzere İslâmî ilimlerde İbâzîlik üzerine yazılan kitap, lisansüstü tez, makale ve bildirilerin bir bibliyografyası hazırlanmış ve Cumhuriyet döneminde İbâziyye araştırmalarının tarihi seyri incelenmiştir. İslâm mezhepleri tarihi bilim dalında (...) İbâzîlik üzerine yapılan çalışmalarda iki temel yaklaşımın benimsendiği görülmüştür. Birinci yaklaşıma göre, Sünnî bakış açısıyla geleneksel mezhepler tarihi kaynakları esas alınarak, İbâziyye Hâricîlerin devamı olarak kabul edilmiştir. Bununla birlikte İbâzîlerin bu konudaki itirazları göz ardı edilmiştir. İkinci yaklaşıma göre ise, Sünnî kaynakların yanında İbâzî kaynaklar da esas alınarak fırka anlaşılmaya çalışılmıştır. Burada müellifler İbâziyye’yi kendi kaynakları üzerinden tanımlayarak, Hâriciyye’den bağımsız bir mezhep olarak değerlendirmişlerdir. İbâziyye’nin Hâricî düşünce yapısından farklılaşan yaklaşımları nedeniyle onlardan ayrılarak, günümüze kadar ulaşmayı başardığını vurgulamışlardır. Mezheplere ilişkin yapılan araştırmalarda objektif veriler ortaya koymak için kaynakların karşılaştırmalı olarak ele alınması gerekmektedir. Aksi hâlde yapılan çalışmalar, doğru verileri yansıtmak yerine sonuçları bilimsellikten uzak, tek taraflı bakış açısının ürünü olarak kalmaktadır. Bu sebeple fırkalar incelenirken, kendi kaynaklarındaki tanımlamalarına da yer verilmelidir. Ancak İbâziyye fırkasına ilişkin kaynakların birçoğunun günümüze kadar ulaşmamış olması yahut siyasî, itikadî, fıkhî görüşlerinin yeterince tanınmamış olması gibi nedenler; İbâziyye’nin gerçekte olandan farklı bir zeminde, yanlış bilgiler üzerinden tanınmasına sebebiyet vermiştir. Bunun yanı sıra mezheplerin, teşekkül sürecinin ardından sistematik hâle gelmesine kadar ki dönemde dinamik yapıda olmaları da göz ardı edilmemesi gereken bir diğer husustur. Bu bağlamda araştırmacılar İbâziyye mezhebinin ortaya çıkışından sistematikleşmesine değin oluşturduğu kendine has görüşleri açıklığa kavuştururken, birincil kaynaklar üzerinden mukayeseli okumalar yaparak, bütüncül olarak analiz etmeleri gerekmektedir. Çalışmamızda Cumhuriyetin ilk yıllarından günümüze kadar İbâzîlik üzerine yapılan araştırmaların bir bibliyografyasını sunduk ve yukarıda belirtilen yaklaşım biçimlerini analiz ettik. Bu kapsamda İslâmî ilimler literatüründe İbâziyye fırkasına ilişkin veriler sunan araştırmacıların konuya dair yaklaşımlarını literatür taraması sonucunda tespit ederek kronolojik olarak sıraladık. Araştırmamız neticesinde, İbâzîlerin kendi kaynaklarını temel alan özgün akademik çalışmaların uzun süre sınırlı kaldığı ve sayıca az olduğu ancak son yıllarda bu alandaki araştırmaların belirgin bir artış gösterdiği sonucuna ulaştık. "This book brings together articles, which I previously published on my blog, Barrarsīhā-ye Tārīkhī, about the history of kalām and falsafa (Islamic theology and philosophy). Many of the articles contain research on the history of Muʿtazilī kalām, especially among the Shīʿa, whether Zaydīs or Imāmīs. Some articles also discuss the history of philosophical theology in Islam, the Avicennian tradition in Khurāsān and the relationship between the theologians and the philosophers, especially in the sixth and seventh centuries hijrī. A chapter about (...) the maktab-e tafkīk is also included, in which the relationship between the Akhbārī position and the philosophical approach among the Imāmiyya, is discussed. In addition, some of the articles treat the concept of imāma according to Zaydī and Muʿtazilī thinkers, and the genre of imāma in their literature, as well as the refutations that were written between Zaydīs and Muʿtazilīs, and also Imāmīs. Some articles on the history of Sunnī kalām are also included. Part of the book takes a bibliographical approach, or is based on texts, and part takes a historical approach to study the history of kalām and falsafa as well as the relationship between both. The purpose of this book is to provide readers a historical reading of the history of kalām and falsafa —mostly within the Shīʿī and Muʿtazilī traditions. Even at present, many Muʿtazilī texts have not been edited and studied. Although most of the texts of Ibn Sīnā and his students have already been edited, we still need to provide a historical approach to the falsafa of Ibn Sīnā in order to situate the philosophical questions in the Avicennian tradition in a broader context, among the theologians and the philosophers. Many of the topics which are discussed in the Avicennian tradition are also approached in theological texts by the Muʿtazilīs and the Ashʿarīs, and I hope that this book provides a basic foundation in preparation for future studies on this topic." -- from publishers. Understanding the developments in the early period when Ṣūfism became widespread in the Islamic society, both necessitates studies on other disciplines from Ṣūfism, and also requires the consideration of Ṣūfism from the perspective of other religious sciences. In this regard, one of the important names is the famous Ḥanbalī scholar Abū Yaʿlā al-Farrā. Abū Yaʿlā al-Farrā who was interested in ḥadīth, Islamic law and tafsīr as well as Ṣūfism and theological issues, has an important place especially with his works in (...) the Ḥanbalī tradition. Abū Yaʿlā, who grew up in a period when the Sunnī theology schools were formed, spread and exercised its influence, he maintained the Ḥanbalī viewpoint and criticized both some schools of kalām and the Ṣūfis by using the kalām method. Therefore, analyzing his views is important for understanding the formative conditions of the first period of religious science tradition, as well as giving clues about the relationship between Ṣūfism and Ḥanbalī tradition. In this article, his views of zuhd, tawakkul and Ṣūfism in general is examined in the context of his works Kitāb al-Muʿtamad fī uṣūl al-dīn and Kitāb al-tawakkul, and his importance in understanding the relationship between Ṣūfism and Ḥanbalī tradition is emphasized. Klasik Sünnî kelâmın sıfatların ‘ne Tanrı’nın aynı ne de Tanrı'dan ayrı' olduğunu iddia eden ilâhî sıfatlar teorisi, üçüncü halin imkansızlığı yasasının inkarı anlamına gelecek şekilde yorumlanmıştır. Nitekim bu iddiada olan yazarlar, böyle bir teoriyi dışarıda bırakacak şekilde yeni bir kelâm inşa etme iddiasındadır. Yazar, böyle bir iddiayı kendinde anlamsız görmekle birlikte, klasik kelâm nazariyesinde de bir temeli olmadığını iddia etmektedir. Bu makale, ‘gayr’ın anlamı hakkında ayrıntılı bir inceleme sunmakta ve birçok metinsel kanıtla, klasik ilâhî sıfatlar teorisinin yalnızca özdeşliğin ve ilâhî (...) zâttan ayrılabilirliğin inkarı anlamına geldiğini öne sürmektedir. Bu makale, gayr teriminin metafizik, teoloji ve doğa felsefesi bağlamlarında da geçerli olduğunu göstermektedir. “Bir şey bir diğerinin ne aynı ne de ayrıdır” formülü, bir öznenin kendisinden zorunlu ve ayrılmaz olan herhangi bir özelliğine eşit şekilde uygulanır. In the verse (2:31) of the Qur’ān, it is mentioned that all names were taught to Adam (PBUH). This verse indicates that revelation is decisively the source of language. On the other hand, it is a common fact that people have been constantly producing symbols to express new ideas and concepts. This situation makes it necessary to associate the utterance (muṭlaq) and static with the relative (al-muqayyah) and dynamic between language and reality in religious thought. In the historical process, Mutakallims (...) have undertaken the responsibility of understanding and interpretation between the transcendent dimension of the religion (ad-Dīn) indicated in the Qur’ān and the innovative and dynamic dimension of life. The Mutakallims’ responsibility continues today. However, to establish the relationship among language, thought, and existence in today’s kalâm, it is necessary to identify the roots of this subject in kalām’s classical sources. In our study designed for this purpose, the truth and value of naming divine meanings in the context of ta‘līm al-asmā’ are examined. On the other hand, since dealing with such a large subject in a limited study is not possible, it is just focused on the research of linguistic theories, the relationship between language and thought, and the issue of whether the names used in the main sources to indicate the meanings are divinely determined (tawqīfī). In fact, it has been determined that the subject of ta'līm al-asmā’ is overshadowed by the vehement debates over the createdness of the Qur’ān (Khalq al-Qur’ān) and the relationship between Allāh’s essence and His attributes, although it is a Qur’ān-centered issue. As can be seen in the study, the approach of the Mutakallims to the issue of ta‘līm al-asmā’ is parallel to their understanding of Allāh’s essence and His attributes. As stated in this research, if the divine names were determined by Allāh, then Allāh’s names will be eternal. Besides, if the names expressed in human languages are the same as the essence of Allāh, this will lead to the problem of eternality. If it is said that the names are separated and unrelated from Allāh’s essence, there will be also more than one independent and eternal being. The idea of multiple eternal beings is against the principle of tawḥīd. However, in cases where the distinction between attributes and essence of Allāh is separated from each other in the mind, it causes attributes to be considered as something existing independently of the essence of Allāh. Therefore, as stated in the study, Mu‘tazilite theologians, who were very sensitive about this issue, attached great importance to the concept of eternity (qadīm) while transcending the essence of Allāh from the attributes of the created. As they appealed to tanzīh by which they transcend Him from all the originated things in time, they were focused on His eternality (qidam). In this regard, all His actions concerning the universe are regarded as temporal, in other words, originated in time (ḥādith). From this point of view, according to them, Allāh’s names specified in the Qur’ān are created just like the Qur’ān itself. Although their meanings are within the boundaries of the Divine Knowledge, their wordings (lafiẓ) belong to humans. Therefore, these names (asmâ’) that people use to describe Allāh in their speech, as Abū ‘Alī al-Jubbā’ī argues, are determined by the convention of the human. It has been determined by people via consensus, like other words of the language, to indicate the essence and attributes of Allāh in a language because of communication. Then, Allāh has sent down His message to people with these words. The conclusion that Mu‘tazilite theologians have regarded the connection of names with the meanings in Allāh’s knowledge as a linguistic use, while Sunnī theologians have addressed this issue based on the creative act (Khalq) of Allāh. There is another explanation which is known as the theory of faculty or habitus as an alternative way. Some Ash‘arî and Māturīdī theologians supported this theory. Today, the importance of this new perspective is clear, which appears another association of both ideas. In this context, it has been determined that the views of Māturīdī, who attributes the content (or meaning) of revelation (waḥy) to Allāh while arguing that its wordings belong to humans, are more appropriate to the theory of the faculty (malakah). Al-Qādī al-Nu´mān b. Muhammad es el más destacado y prolífico de los estudiosos fatimíes y el fundador de la jurisprudencia ismā´īlí. En su epístola “La clarificación elocuente para la refutación de Ibn Qutayba”, todavía en manuscrito, al-Nu,mān se lanza a una polémica en contra de Ibn Qutayba, que había vivido un siglo antes. Es probable que la epístola fuera escrita en la época de al- Mu´izz a petición de un tutor anónimo de los hijos del califa. En ella, al-Nu´mān se (...) propone refutar la afirmación de Ibn Qutaybba, incluida en la introducción de su famosa obra Adab al-Kātib, según la cual era suficiente para la realización de sus tareas que los kuttāb, o funcionarios del estado, memorizaran una serie de fórmulas legales simples, sin tener que aprenderse las largas disertaciones de los fuqahā’ o doctores de la ley. Al-Qādī al-Nu´mān, un faqīh famoso, se dedica en la epístola a demostrar que sin estas disertaciones no se podía aplicar la ley correctamente. En su texto se refiere a cada fórmula legal mencionada por su rival en Adab al-Kātib y demuestra cómo la ley se debería aplicar basándose en la autoridad de los imāmes del Ahl al-Bayt, la Familia del Profeta Muhammad. The early period Ismaili jurist Al-Qādî al-Nu'mān appears as an important figure in the formation of Ismaili jurisprudence. There is very little information about Kadı Nu'mân's family, childhood, education and intellectual environment. His full name is Abû Hanîfah Nu'man b. Muhammad b. Mansûr al-Qādî at-Tamîmî Al Qayrawānî. He was born around 290/903 (late 3rd (9th) century) into an educated family in Qayravan in North Africa. There are different opinions about the sect he belonged to when he was growing up. On (...) the other hand, it is difficult to say for certain whether Nu’mān received education in the Ismaili sect due to the understanding of taqiyya in the madhhab. However, it is understood from the basic jurisprudence texts Nu’mān wrote that he most likely did not receive a Sunni education. Historians refer to him as 'Qadi Nu’mān or Abu Hanifah al-Shi'i' in order not to confuse him with the imam of the Hanafi school. Qādî Nu’mān served at different levels of the Fatimid State. Around 313/925, he entered the service of the first Fatimid caliph, Mahdi (r. 909-934 CE/297-322 AH), as a copyist and secretary. During the reigns of the third caliph Mansur and the fourth Fatimid caliph Mu’izz (d. 365/975), Qādî Nu’mān first served as a judge in Tripoli and then in Mansouriya, the Fatimid capital. After the Fatimids conquered Egypt and the center of government was moved to Cairo, Qādî Nu’mān was appointed by the fourth caliph Mu’izz as the head of the appellate courts (maẓālim). Qadi Numans career was at the peak in the period of Caliph Muiz. Qādî Nu’mān worked as a judge in the Fatimid State for about twenty-six years and continued this duty until his death in 363 (973). After the fall of the Fatimid caliphate, there haven’t been any other Fatimid or Ismaili jurists. Qādî Nu’mān is considered by contemporary Ismaili writers as a figure who systematically transformed Ismaili fiqh into an independent sect of fiqh. It can be said that Ismaili fiqh was developed through his works in the Fatimid period. His works continued as the main references in the fiqh studies and after the Fatimid period. With the death of Qādî Nu’mān, the period of ijtihad in Ismaili fiqh and its the establishment phase of Ismaili fiqh came to an end; The sect, in which esoteric interpretations were at the forefront, emerged as a distinctive school of fiqh by discarding ambiguity. Qādî Nu’mān was a very productive writer. He wrote important works related to the field of furu al-fiqh and usûl al-fiqh. Among his works, Ikhtilāf uṣūl al-madhāhib is undoubtedly one of the most important works in the early history of fiqh methodology. The work in question, which was originally written with the aim of rejecting the Sunni fiqh method, discusses the approaches of the Sunni schools of fiqh on ikhtilāf, taqlid, ijma, nazar, qiyas, istihsan, ijtihad and ra’y in a polemical manner. It reveals the differences of the Ismaili method from the Sunni method in terms of the sources on which the fiqh is based, the authority to make ijtihad and the theory of interpretation of the texts. Qādî Nu’mān examined the relationship between reason and revelation in general and the role of religious authority in comprehending and interpreting the texts while criticizing Sunni methods. Ikhtilāf uṣūl al-madhāhib has the characteristics of the works of development period as a form. It is possible to observe the question-answer and dialectic form which can be seen in the works of the development period throughout the work in question. Qādî Nu’mān endeavoured to persuade his opponents with a dialectical and argumentative style. Again, he replied to the Sunnis, who were his interlocutors, with their own proofs. In addition to these, Ikhtilāf uṣūl al-madhāhib has a unique feature in the matter of content. Because it is not very familiar to any Sunni handbook of usûl al-fiqh. It does not mention the hâss, âmm, ijma, qiyas, amir, nahy, alfaz bets, etc. The text is very similar to the Ahbari movement of the Jafari sect for it rejects all forms of ijtihad. It was written at a time when fiqh was not yet stable. Ikhtilāf uṣūl al-madhāhib gives us crucial information about the development of different usûl and fiqh sources in the middle of the fourth century. However, what is interesting here is that the information he gives about Ismaili method and fiqh is very little compared to the one about Sunni method and fiqh. Much of it centered on Sunni thought and its rejection. However, his ultimate goal was to defend the Ismaili doctrine. (shrink)

In our time, the role of religions has gained a great influence again, a number of serious scientific researches have been conducted in this field, scientific information and teaching-learning activities have increased, and the interest of intellectuals in the subject has increased. Because religion is also a system that guides people as a moral institution. During our independence, "missionaries" from foreign countries, especially from (...) the West and East, were more active. Their attempts to create discord between Muslims and non-Muslims, Sunnis and Shiites within our country were stronger and more insidious. It was our national leader Heydar Aliyev who took a decisive step against those who came to our country from the West and the East and wanted to create trouble here. With his special decree dated January 8, 1997, he prohibited the disruptive activities of foreign religious missionaries in Azerbaijan. With this, the genius leader laid the foundation for the formation of religious beliefs in our modern world and indicated its direction. Our national leader Heydar Aliyev, who understands the essence of religion to all its subtleties, assessed the effective use of its spiritual and emotional influence as one of the fundamental principles of the Azerbaijani ideology. Our national leader highly appreciated the importance of Islamic moral norms in the national-moral mentality and worked effectively in the direction of their development and dissemination. Therefore, we can say that the political activity of our Great Leader in the direction of maintaining national and moral values is always relevant, and this policy is one of the most important tasks of Azerbaijan's statehood. Today, the state of Azerbaijan has become the guarantor of our national and moral values. Mr. President pays serious attention to the promotion of the national and moral values of our people and the upbringing of our youth in this spirit. President Ilham Aliyev's views on national ideology embody the main features of his political portrait. Our people also appreciate the extensive activities of the Foundation named after our national leader Heydar Aliyev in the direction of protecting and promoting our national and moral values. Sünnî usulcülere göre sahih olan haber-i vahid zan ifade etmekle birlikte, böyle bir haberle amel etmek naklî ve kat’î delillerin bir gereği olarak vaciptir. Şiî-Usûlî geleneğin temsilcilerinden Şerif Murtazâ ise haber-i vâhidle amel etmenin aklen caiz olduğunu, ancak bunun dinî açıdan vacip olmadığını iddia etmiştir. Ona göre Kur’an, mütevâtir haber ve masum imamın dâhil olduğu icmâ kesin bilgi kaynağı olduğundan bağlayıcıdır. Haber-i vâhid ise zann ifade etmektedir. Böyle bir haberle amel etmeyi gerektiren naklî kat’î bir delil ise bulunmamaktadır. Bu nedenle (...) haber-i vâhid amelî konularda hüccet değildir. Şerif Murtazâ, Sünnî usulcülerin haber-i vâhidin hüccet olduğuna dair naklî kat’î delillerini eleştirmiş, usulcüler ise bu eleştirilere cevap vermişlerdir. Araştırmamız Şiî-Usûlî geleneğin haber-i vâhide yaklaşım evreninden Şerif Murtazâ örneğini ele almayı ve Sünnî usulcülerin görüşleriyle mukayese etmek suretiyle değerlendirmeyi hedeflemektedir. Şerif Murtazâ’nın âhâd haber konusundaki yaklaşımı özü itibarıyla masum imam teolojisine dayanmakta-dır. Araştırmada masum imam teolojisinin ve haber-i vâhidle amel etmeyi gerektiren kat’î bir delilin bulunmadığı iddiasının nas, icmâ, tevâtür ve makul açısından vakıaya aykırı tutarsız bir görüş olduğu tespit edilmiştir. Bu çalışmada İslam düşünce tarihinde çokça ele alınan yönetime gelmede “nass ile tayin” anlayışına yönelik genelde Mu‘tezile’nin özelde ise bir Mu‘tezilî âlim Ebû Tâhir Rüknüddin et-Tureysisî’nin eleştirileri konu edinilmektedir. “Nass ile tayin” anlayışı Kur’ân âyetleri ve hadisler üzerinden temellendirilmeye çalışılan bir husustur. Şii çevrelerle özdeşleşen bu anlayış bazı Sünnî ekollerde de dillendirilmiştir. Genelde dördüncü halife Ali’nin imâmeti çerçevesinde konu tartışılsa da bazı çevrelerde birinci halife Ebû Bekir’in imâmeti için de nass ile tayin iddia edilmiştir. Mu‘tezile temelde Şîa’nın imâmet anlayışına birçok (...) eleştiri yöneltmiştir. Bu iddialar doğrudan Kur’ân metni üzerinden yapıldığı için âyetler bağlamında yeniden konunun değerlendirilmesi gerekmektedir. Bu noktada Mu‘tezilî bilgin Tureysisî’nin yaklaşımı önem arz etmektedir. O, mezheplerin görüşlerini temellendirmede esas aldıkları âyetleri dilin ve aklın sınırında anlama çabası içerisinde olduğu Müteşâbihü’l-Kur’ân adlı eserinde “nass ile tayin” fikrine yönelik eleştirilerini sürdürmektedir. Hem İmâmiyye’nin hem de Bekriyye’nin iddialarını âyetler bağlamında ele almakta ve bu fırkaları tenkid etmektedir. (shrink)

Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Tefvîz meselesi ictihada başvurmaksızın ilkten hüküm koyma esasına dayanan girift bir meseledir. Şer’î ahkâmın kaynağı ya vahiy veya vahyin ışığında ictihaddır. Tefvîzde ise hüküm herhangi bir vahiy veya ictihada dayanmayıp, Allah tarafından daha önce verilen yetkiye dayanmaktadır. Tefvîzde ilkten ve re’sen bir hüküm koyma söz konusudur. Usulcüler arasında böyle bir yetkinin imkanı tartışılmış, mesele etrafında kabul ve red şeklinde temel iki görüş ortaya çıkmıştır. Bu ihtilafın temelinde hüsün ve kubuh etrafındaki kelamî tartışmaların önemli rol oynadığı anlaşılmaktadır. Tefvîzi kabul eden usulcüler (...) kendi içerisinde aklen cevaz verenler; hem aklen hem de fiilen mümkün görenler şeklinde ayrışmışlardır. Kabul eden usulcüler detayda da ihtilaf etmişler kimi usulcüler tefvîze peygamber, müctehid/âlim ve hatta âmmî bakımından cevaz verirken, kimisi sadece peygamber bakımından, kimisi hem peygamber hem de müctehidler bakımından cevazına hükmetmişlerdir. Çoğunluğu Mu‘tezile mensubu olan usulcüler ise ne aklen ne de fiilen gerçekleşmesini mümkün görmemişlerdir. Hem aklen hem de fiilen cevaz veren ve tefvîzi peygamber ve âlimlere teşmil eden usulcüler arasında Mu’tezilî âlim Müveys b. İmrân’ın adının ön plana çıktığı görülmektedir. İmam Şâfiî ve Şâfiî usulcüler de aynı grup içerisinde yer almış olmakla birlikte özellikle İmam Şâfiî’nin görüşü noktasında net bilgiler sunulamamıştır. Hem aklen hem de fiilen gerçekleştiğini kabul eden usulcüler görüşlerini aklî ve sem’î delillerle temellendirmeye çalışmışlardır Tefvîze cevaz veren usulcüler ayrıca tefvîzi şer’î hükmün kaynaklarından biri olarak kabul etmişlerdir. Tefvîze cevaz vermeyen ve çoğunluğunu fukahâ/Hanefî metoduna mensup alimlerin oluşturduğu usulcüler ise şer’î hüküm kaynaklarının vahiy ve ictihad olduğuna vurgu yaparak peygamber de olsa bunların dışında başka bir teşrî’ kaynağı bulunamayacağını iddia etmişler, onlar da iddiaların aklî ve naklî delillerle gerekçelendirmeye çalışmışlardır. Şîî usulcüler arasında tefvîzi temelden reddedenler olduğu gibi kabul ve red şeklinde sünnî usulcülerle benzer yaklaşımlar sergileyen alimler de bulunmaktadır. Bazı aşırı Şîa fırkaları arasında tekvînî tefvîz denen bir anlayış da bulunmaktadır. Bu anlayışa göre âlemin yaratılması, idare edilmesi, öldürme, diriltme, rızık verme, âhirette ceza ve mükâfat verme gibi hususlar Allah tarafından Hz. Peygamber, Hz. Ali ve imamlara havale edilmiştir. Fakat bu anlayış mutedil Şîa alimleri tarafından şiddetle reddedilerek bunu savunanların küfrüne hükmedilmiştir. Kimi usulcülerin ictihadla tefvîzi birbirine karıştırdıkları veya en azından tefvîzi de ictihad kapsamında gördükleri anlaşılmaktadır. Oysaki tefvîzin en temel özelliklerinden biri ictihada başvurmadan hüküm vermektir. Dolayısıyla böyle bir yaklaşım isabetli gözükmemektedir. (shrink)

Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında burada tartışma konusu yapılan hadisler haberî sıfatları konu alan ve müşkil nitelikte olan rivayetlerden oluşmaktadır. Bu rivayetleri genelde Bişr el-Merîsî ve taraftarlarının tecsîm ve teşbîh içerdiği iddiasıyla münker kabul ettikleri görülmektedir. Ehl-i re’y özellikleri taşımakla birlikte ilahî sıfatlar konusunda Mu’tezilî bir anlayışa sahip olduklarından tenzih anlayışları gereği sıfatları reddetmektedirler. Yaratılmışlara ait niteliklerin yaratıcıya nisbet edilmesini tenzîh anlayışlarına aykırı gördüklerinden bu tür müşkil rivayetleri ya kendi anlayışları doğrultusunda te’vîl ya da reddettikleri gözlenmektedir. Sert bir (...) ehl-i hadîs âlimi olan Osman ed-Dârimî ise, ayet ve hadislerde bildirilen ilahî sıfatlara iman edilmesi gerektiğini kabul etmektedir. Bu anlayışı sebebiyle bu rivayetlerde bildirilen haberî sıfatlara da te’vîl etmeksizin lafzî anlamıyla yaklaşmakta; kendi görüşü doğrultusunda Bişr el-Merîsî ve taraftarlarının yaptığı te’vîlleri reddetmekte, bu te’vîllerin ta’tîle yol açacağını ileri sürmektedir. Bu rivayetlerin lafzî (literal) anlamları doğrultusunda anlaşılması gerektiğini savunmaktadır. Bu hadisler üzerinde yapılan tartışmalar, temel hadis eserlerinin yazıldığı dönemde Ehl-i re’y ve Ehl-i hadîs ekollerine mensup âlimlerin hadislere yaklaşımlarını göstermesi bakımından önem arzetmektedir. Burada vermiş olduğumuz hadisler üzerindeki tartışmalar bu iki ekolün uluhiyet anlayışını, haberî sıfatlara yaklaşımlarını ortaya koyduğu gibi bunların genel anlamda hadis perspektifi hakkında bizlere bilgi vermektedir.ÖzetBu araştırma, temel hadis kitaplarının yazıldığı dönemde, yani III./IX asırda, haberî sıfatlar ihtiva eden bazı hadisler üzerinde yapılan tartışmaları ele almaktadır. Tartışma Osman ed-Dârimî (ö. 280/894) ile Bişr el-Merîsî’nin (ö. 218/833) taraftarları arasında geçmektedir. Hadisler üzerinde Ehl-i hadîs ile Ehl-i re’y mensubu âlimler arasında gerçekleşen bu tartışmalar bir yönüyle hadislerin anlaşılması ve yorumlanmasını ilgilendirmektedir. Tartışmanın, burada ele alınan hadislerin nasıl anlaşılması gerektiği; lafızların kelime anlamı mı (literal) yoksa bu lafızların ötesindeki muhtemel mecazî anlamları dikkate alınarak mı anlaşılması gerektiği noktasında odaklandığı söylenebilir. İnceleme konusu yapılan hadisleri tartışan tarafları kısaca tanıtmak yerinde olacaktır. Sözünü ettiğimiz rivayetlerle ilgili tartışmalar Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında geçmektedir. Ehl-i hadîs’in önemli simalarından biri olan Osman ed-Dârimî, hadislerle ilgili bu tartışmaları içeren ayrı bir eser yazmıştır. Bu eser, Allah’ın sıfatları ve bazı hadis meseleleri konusunda Bişr el-Merîsî ve onun iki talebesinin görüşlerine reddiye olarak yazılmıştır. Bişr el-Merîsî, Ebû Yusuf’tan (ö. 182/798) fıkıh tahsil etmiş, önemli bir kelâmcı olarak tanınmıştır. O, kelâmla ilgili konularda aralarında İmâm Şâfiî’nin (ö. 204/820) de bulunduğu pek çok âlimle ilmî tartışmalar yapmış bir ehl-i re’y âlimdir. Halife Me’mûn’un (ö. 218/833) danışma meclisinde bulunmuş, Kur’ân’ın yaratılmışlığı (Halku’l-Kur’ân) görüşünün benimsenmesinde önemli payı olmuştur. Osman ed-Dârimî ise, Yahyâ b. Ma’în (ö. 233/848), Ali b. Medînî (ö. 234/848-49), İshâk b. Râhûye (ö. 238/853) ve Ahmed b. Hanbel (ö. 241/855) gibi döneminin otoritelerinden hadis öğrenmiş bir ehl-i hadîs âlimidir. Hadis tahsili için önemli bütün şehirleri dolaşarak hadis öğrenmiş ve rivayette bulunmuştur.Haberi sıfatları ispat ve bunlarla ilgili rivayetlerin teviline karşı çıkan anlayış ile, bu rivayetlerin tenzih anlayışına uygun biçimde tevilini savunan kesimler ilk dönemden itibaren eserler telif etmişlerdir. Osman ed-Dârimî’ye göre, ehl-i hadîs’in eleştiri edebiyatının ortaya çıkmasında, Mu’tezile’nin ilahî sıfatları reddetmesi etkili olmuş ve pek çok müellif bu yönde eserler yazmışlardır. Ebû Hüreyre’den nakledilen bir rivayetle ilgili olarak muârız, bu rivayetin Allah için bildiğimiz göz ve kulak organlarından oluştuğu izlenimi verildiğini söyler. Osman ed-Dârimî, bu hadisin göz ve kulak organlarını değil görme ve işitmeyi ispat ettiğini söyler. Hiçbir konuda Allah’ın benzerinin bulunmadığını belirtir. Dolayısıyla Allah’ın organlardan oluştuğu iddiasını ehl-i hadîs’e nisbet etmek iftiradır. Ebû Dâvûd, bu hadis ile Allah için görme ve işitme sıfatlarının ispat edildiğini ve Cehmiyye’nin ilahî sıfatları inkar görüşüne reddiye olduğunu belirtir. Ebû Hüreyre’in Hz. Peygamber’e nispet ederek naklettiği: "İman Yemenlidir, hikmet Yemenlidir! Ben Rabbi’nizin nefesini Yemen tarafından hissediyorum!" rivayetini de muârız münker kabul etmiştir. Çünkü Bişr el-Merîsî ve ashâbına göre nefes ancak karın boşluğu olanlardan çıkar, Allah ise bundan münezzehtir. Osman ed-Dârimî’ye göre, muârız yanlış anlamıştır. Burada kastedilen, Yemen tarafından esen ve insanı rahatlatan rüzgardır. Bu rivayet bağlamında bakıldığında, Bişr el-Merîsî taraftarlarının rivayeti literal değerlendirdiğini, Osman ed-Dârimî’nin ise rivayeti yorumladığını görmekteyiz. İbnü’s-Selcî, "Siz, Allah’a ondan çıkandan (Kur’ân’dan) daha faziletli bir şeyle yaklaşamazsınız!" rivayeti hakkında, Müşebbihe’nin bunu, karın boşluğu olan, kendisinden kelâm çıkan şeklinde anladıklarını belirtir. Allah boşluğu olmayan anlamında "samed" olduğundan bu anlayış geçersizdir. Bu hadisle, Kur’ân’ın Allah’tan değil O’nun katından çıkması kastedilmiştir. Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin asıl maksadı Allah’ın kelâm sıfatını inkâr etmektir. Kur’ân’ın O’ndan çıktığında bir şüphe yoktur, bunu sadece kelâm sıfatını kabul etmeyenler inkâr etmektedir. İbn Abbâs’a atfedilen; "Rükn (Hacerülesved) yeryüzünde Allah’ın sağ elidir, halk ile onunla musafaha eder" rivayetinde geçen "yemînullah" (Allah’ın sağ eli) sözünün anlamı, İbnü’s-Selcî’ye göre bildiğimiz sağ el değil, Allah’ın nimeti ve ikrâmıdır. Hacerülesved ile elin kastedilmediğini kabul eden Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin maksadı, geçersiz te’villerle Allah hakkında ayet ve hadislerde belirtilen iki eli inkar etmektir. İbn Abbâs’ın Hz. Peygamber’den naklettiği başka bir rivayeti İbnü’s-Selcî’nin eserine alıp nakletmesini eleştiren Osman ed-Dârimî, bu tür zayıf rivayetlerin yayılmaması gerektiğini söyler. Buna ilave olarak İbnü’s-Selcî’nin yaptığı yorumun da çirkin olduğunu belirtir ve eleştirir. Çünkü sözü edilen rivayette Allah, yeşil bir takım elbise giymiş kıvırcık saçlı bir genç olarak tasvir edilmektedir. Böyle bir rivayet Hz. Peygamber’den gelen sahih rivayetlerle çeliştiği için de güvenilmez bir rivayettir. Rivayetle ilgili bu değerlendirmeyi yapan Osman ed-Dârimî, rivayet hakkında muârızın yaptığı yorumları da reddeder. Muârıza göre, "Rabbimin yanına girdim" sözü, "Adn cennetinde Rabbimin huzuruna girdim" demektir. Osman ed-Dârimî’ye göre bu gibi müşkil (problemli) hadisler re’y ile tefsir edilmemeli, rivayet edilip bırakılmalıdır. Hz. Peygamber’e dayandırılan ve Allah’ın kendisine geldiğinden bahisle cevabını bilemediği bazı sorulan sorduğundan, sonra Rabbinin elini sırtına koymasıyla parmaklarının serinliğini hissettiğinden ve her şeyi öğrendiğinden bahseden rivayetle ilgili olarak muarız şu değerlendirmede bulunur: Allah Resûlü’ne gelen Rabbi değil güzel suretli bir melekti, o melek Allah tarafından yönledrilmekteydi ve elini koyan da o melekti. Osman ed-Dârimî, muârızın bu yorumunu reddeder. Bu yorum aynı zamanda diğer sahih hadislere de aykırıdır. Osman ed-Dârimî, sözkonusu rivayet hakkında muârızın yorumunu reddettikten sonra zikrettiği sahih rivayetlere dayanarak buna güvenilemiyeceğini ifade etmiştir. İlahî sıfatlar hakkında konuşmak en zor konular arasında görüldüğünden, selef âlimleri bu konuda susmayı tercih etmişlerdir. Ancak sonraki nesiller bu konuda farklı yollar tutmuşlardır. İlahi sıfatları anlama konusundaki temel yaklaşımları tefvîz, teşbîh ve te’vîl şeklinde üç ana başlıkta toplamak mümkündür. Tefvîz, selef alimlerinin benimsediği yol olup, Allah’ın zâtı ve sıfatlarının mahiyetine ilişkin bilgiyi ilâhî ilme havale etmek demektir. Teşbîh, Allah’ı yaratılmışlara veya yaratılmışları Allah’a benzetmek anlamına gelir. Te’vil, Allah’ın yaratılmışlara benzediği izlenimini veren ayet ve hadisleri dil bilimi ve aklî bilgilerle yorumlamaktır. Sıfatları inkar edenlere Muattıla denilmiş, sıfatları ispat edenler Sıfâtiyye diye anılmıştır. Ehl-i re’y’e göre Allah’a atfedilen ve sözlük anlamı bakımından teşbîh ve tecsîm izlenimi veren sıfatları uygun biçimde te’vil etmek gerekir. İlâhî sıfatlarda Mu’tezile tenzihi öne çıkarmış, Eş’ariyye ve Mâtürîdiyye ise tenzihe uygun te’vili benimsemiştir. Müşebbihe, Vehhâbî-Selefî anlayış da ilahî sıfatlardaki lafızları zahiri anlamlarıyla almışlardır. Hadis ilminde en önemli temel eserlerin telif edildiği II./VIII. ve III./IX. asırda yaşamış olan âlimler arasında cereyan eden inceleme konusu yaptığımız tartışma, ilk döneme ait olması bakımından önemlidir. Bunun yanında tartışma, âyet ve hadislerden oluşan naslara yaklaşımda, iki temel yaklaşımı göstermesi bakımından da önemli bilgiler ihtiva etmektedir. Bu iki temel yaklaşımdan biri ehl-i re’y ekolünü, diğeri ise Ehl-i hadîs anlayışını temsil etmektedir. Osman ed-Dârimî genel olarak rivayetin lafzına bağlı kalmayı savunmakta, Bişr el-Merîsî ve ashâbı ise münker olduğu gerekçesiyle rivayeti eleştirmekte ya da te’vil etmektedir. Nadir de olsa Osman ed-Dârimî’nin rivayeti ret ya da te’vil ettiği, Bişr el-Merîsî ve ashâbının ise rivayeti savunduğu yerler de görülebilmektedir. Müteşâbih (problemli) rivayetler hakkında Bişr el-Merîsî’nin yaptığı te’viller sonraki âlimler üzerinde etkili olmuştur. Onun te’villeri, Cübbâî (ö. 303/916), Kādî Abdülcebbâr (ö. 415/1025), Ebü’l-Hüseyin el-Basrî (ö. 436/1044) gibi Mu’tezilî âlimlerin yanı sıra, İbn Fûrek, Gazâlî (ö.505/1111), İbn Akîl (ö. 513/1119), Fahreddîn er-Râzî (ö. 606/1210) gibi sünnî âlimler tarafından da iktibâs edilmiştir. Rivayete dayalı olan hadis ilminde hakikatin ortaya konulabilmesi, "rivayet" ve "re’y" seçeneklerinden birini tercih etmekle değil; bunların her ikisini de yerinde ve dengeli olarak kullanılmasına bağlı olduğunu hatırda tutmak gerekir. Makalenin konusu Ebû Hanîfe örneğinden hareketle İslam düşüncesinde yargı-siyaset ilişkisi-dir. Ebû Hanîfe’nin yaşadığı döneme kadar karizmanın dini ve siyasi kültürde gelişimine paralel olarak yargı-siyaset ilişkileri bağlamında İslam düşüncesinde bazı formlar çoktan ortaya çık-mıştı. Burada amaç İslam’ın henüz ikinci asrında yargı-siyaset ilişkilerini Ebû Hanîfe üzerinden anlamaya çalışmak ve dolaylı olarak da meselenin bugüne yansıyan yönlerine ışık tutmaktır. Bu yüzden farklı sosyolojik düzlemlerde inşa edilmiş Şiî, Haricî, Sünnî öteki formlar çalışma dışında tutulmuştur. Araştırma Ebû Hanîfe’nin; doktrini oluşturan Kur’an, sünnet ve sahabe uygulamaları (...) ile kendi dönemindeki dini, siyasi, sosyal ve kültürel şartlar arasında nasıl bir okuma yaptığını sorunsallaştırmıştır. Çalışmada Ebû Hanîfe’nin yargı-siyaset ilişkisi bağlamın-da ortaya çıkardığı genel anlama biçiminin, işaret edilen dini ve tarihi şartlarla kendi dini top-lumsallaşma çevresindeki diyalektik bir ilişkide şekillendiği varsayılmıştır. Dolaylı gözlem yöntemi ile elde edilen veriler bir tekil olay incelemesi bağlamında fenomenolojik bir çözüm-lemeye tabi tutulmuştur. Konu bugüne kadar ilahiyat bağlamında olduğu gibi din bilimi alanın-da da dikkat çekici görülmemiştir. Makale İslam düşüncesinde yargı-siyaset ilişkisinin farklı desenleri arasında Ebû Hanîfe modelini tartışması bağlamında bir değere sahip görülebilir. Çalışmada; temel hak ve özgürlüklerin korunması noktasında sivil ve barışçıl bir muhalefetin yeterli olmadığı, iktidarın kişisel hakları tanımaktan daha çok kişisel ödevler ve mutlak itaat talebi ile siyaset yaptığı bir ortamda Ebû Hanîfe’nin soruna ahlaki bir saikle yaklaştığı ve bu bağlamda bir çözüm önerisi getirdiği görülmüştür. Ebû Hanîfe gerek otorite ve karizması ge-rekse ekonomik statüsü ve kültürel birikiminden aldığı güç ile yaşadığı dönemde üst düzey siyasal ve hukuki bir katılım gerçekleştirmiştir. Yasama erkinin özgür bir üyesi olarak Ebû Hanîfe temel haklar bağlamında hayatı boyunca hep iktidarlarla karşı karşıya gelmiş ve bu mücadele içinde iken de öldürülmüştür. Müslüman bir ailede doğmasına rağmen dönemin politik tavrı nedeniyle daha doğumuyla birlikte iktidar tarafından öteki olarak görülmüş ve ömrü boyunca bu statü ile yaşamak zorunda kalmıştır. Başlangıçta kendi ailesi içinde toplum-sallaşırken deneyimlediği mevalilik duygusu, Ebû Hanîfe’de özellikle hocasının ölümünden sonra iktidarlara karşı toplumsal bir hak arayışına dönüşmüştür. Esasen kendi özelinde bir hak arayışı olmaksızın iktidarların yasa ile sorunlu politik tavırları karşısında dini, hukuki ve top-lumsal bir tavır içinde yürüttüğü bu mücadelesi Ehl-i Beyt’i ve diğer bütün toplumsal grup ve kategorileri içine alan bir genişlikte ilerlemiştir. Ebû Hanife’nin yargı- siyaset ilişkisine dair bu yaklaşımı teorik ve pratik olarak tamamen sistematik bir çerçevede şekillenmiştir. İslam hu-kukunun dayandığı bilgi gövdeleri kapsamında o, çok kapsayıcı ve dinamik bir tarzda din ve şeriat kavramsallaştırması yapmıştır. Buna göre Ebû Hanîfe dine temel hakların dayandığı temel yasa anlamı yüklerken şeriata ise kendisinin bu dini alana veya başka bir ifadeyle yasaya göre düzenlendiği neshe açık, değişken bir alan anlamı vermiştir. Bu tevhit eksenli hiyerarşi içinde siyaset, yasaya karşı kesin sorumluluğu olan dünyevi bir alan görülmüştür. Ebû Hanîfe’nin İslam’ın ilk dönemini bir hukuk devleti nosyonu içinde değerlendirdiğinde kuşku yoktur. Buna mukabil, genel yargı-siyaset ilişkisine yaklaşımından anlaşıldığına göre yaşadığı dönemi, iktidarlar tarafından hukukun araçsallaştırıldığı bir dönem olarak görmüştür. Kurmuş olduğu akademi onun yargı-siyaset ilişkisine bakışının önemli bir pratiğidir. Bu akademiden yetişen ve daha sonra resmi ve gayri resmi olarak yasamanın bir üyesi olan öğrencilerine tav-siyeleri ve mektupları, onun bir yargı elemanı olarak siyaset kurumuna yaklaşımının sübjektif değil; bir düzen ihtiyacının ortaya çıkardığı objektif bir tavır olduğunu göstermiştir. Ebû Hanîfe teorik yaklaşımını pratik bir eylem alanı ile birleştirmek suretiyle yargı-siyaset ilişkisine bakışı konusunda oldukça net bir fotoğrafa sahiptir. (shrink)

Genel olarak İslam düşüncesini özel olarak da fıkıh düşüncesini derinden etkileyen isimlerden biri de hiç şüphesiz Kâdî Abdülcebbâr’dır (öl. 415/1025). Hayatının çoğu hicrî 4./11. yüzyılda geçen ve Basra Mu’tezilesi’nin Cübbâî’lerden sonra en önemli temsilcisi olan Abdülcebbâr, hem kelam hem de fıkıh usûlü alanındaki eserleriyle sadece Mu’tezilî çevrelerde değil Sünnî muhitlerde de çığır açıcı bir âlim olarak görülmüştür. Birçok Sünnî usûlcünün ortak kanaatine göre İmam Şâfiî’den sonra fıkıh usulü alanındaki en önemli isimlerden biri Abdülcebbâr’dır. Teoloji ve metodoloji alanlarında bu denli etkili (...) olan Kâdî Abdülcebbâr’ın amelî hayatını hangi sistematik çerçevede sürdürdüğü ve öğrenciliği sırasında benimsemiş olduğu Şâfiî mezhebine bağlılığını devam ettirip ettirmediği merak konusu olmuştur. İlgili literatürde Kâdî Abdülcebbâr’ın hayatı boyunca Şâfiî mezhebini benimsediği iddiası çokça dillendirilmiştir. Öyle ki Şâfiî fakihlerin tanıtıldığı tabakât eserlerinde Abdülcebbâr’a bir Şâfiî olarak yer verilmiştir. Günümüze kadar devam eden bu anlayış akademik çalışmalarda da devam eden bir kabul halini almıştır. Acaba gerçek böyle midir? Bu sorunun peşine düşen elinizdeki araştırma, şu adımlarla konuyu incelemiştir: Önce Kâdî Abdülcebbâr’ın fıkıhta takip ettiği yol ile ilgili olarak literatürde zikredilen iddialar sergilenmiş, ardından Abdülcebbâr’ın Mu‘tezile usûlündeki konumu ortaya konmuştur. Mu’tezilî bir âlimin benimsediği iddia edilen mezhebin kurucu imamının yani Şâfiî’nin (öl. 204/820) Mu‘tezile’ye olan mesafesi ve hatta onunla mücadelesine değinildikten sonra Kâdî Abdülcebbâr’ın İmam Şâfiî’nin meşhur usûl görüşlerine muhalif tavırları tespit edilmiştir. Abdülcebbâr’ın usûl görüşlerini İmam Şâfiî’nin usûl görüşleriyle mukayese ederek ilerleyen işbu araştırma, onun amelî sahada Şâfiî mezhebini benimsemiş olduğu iddiasının çok isabetli olmadığı sonucuna ulaşmıştır. Mukayeseyi, Şâfiî usûl düşüncesinin en ayırt edici 6 (altı) meselesi üzerinden yürüten araştırma Abdülcebbâr’ın İmam Şâfiî’ye ve Şâfiî usûlcülere açıkça muhalefet ettiğini göstermektedir. İslam hukuk metodolojisinin en önemli tartışma konuları arasında yer alan bu altı mesele şunlardır: Kur’ân ve Sünnet’in birbirilerini nesh edip edemeyeceği, Peygamber’den nakledilen söz ve fiillerin kabulünün ön şartı olarak bunların Kur’an’a arzı yani delil olabilmesi için Kur’an’ın ilgili düzenlemesiyle uyumlu olup olmadığının tespiti hususu, kıyas sonucu ulaşılan hükmü bir gerekçeye dayanarak terk edip başka bir hüküm koymak demek olan istihsân, çözüm bekleyen yeni meselenin iki veya daha fazla asla/makîsün aleyhe birden benzemesi halinde birçok açıdan en çok benzediği düşünülen aslı dikkate alarak söz konusu yeni meseleye bu aslın hükmünü vermek demek olan şebeh kıyası, mefhûmu’l-muhâlefenin yani bir sözün ters anlamının o sözdeki meselenin tam tersi olup hükmü belirtilmeyen meseleye aktarımı anlamına gelen karşıt kavram kanıtının sahih bir istidlal sayılıp sayılmaması ve emir kipinin hangi anlama geleceği konusu. İslâm geleneğinin en akılcı fırkası kabul edilen Mu‘tezile’nin özellikle Kur’an kıssaları çerçevesinde tefsirlerde yer bulan israilî rivayetler karşısındaki tutumu merak uyandırıcıdır. Bazı çalışmalarda kimi Mu‘tezilî müfessirlerin isrâiliyyât karşısındaki tutumuna değinilse de İsrâilî rivayetlerin tenkidi söz konusu olduğunda Mu‘tezile’nin bir ekol olarak tutumu herhangi bir araştırmaya konu edilmemiştir. İsrâiliyyât üzerine yapılan son çalışmalarda isrâiliyyât eleştirisinin İbnü’l-Arabî öncesinde Tûsî, Mâverdî hatta Mâtürîdî gibi isimlere kadar geri götürülebileceği söylenirken tamamen Sünnî ve Şiî müfessirler üzerinden bir okuma yapılmakta Mu‘tezilî müfessirlerin görüşlerine yer verilmemektedir. Oysa (...) bu çalışmalarda bahsedildiği üzere erken dönem isrâiliyyât eleştirilerinin genelde ismet meselesi ekseninde yapılması, Mu‘tezilî müfessirler özelinde bir incelemeyi zorunlu kılmaktadır. Nitekim isrâiliyyât eleştirisinde ön plana çıkartılan Mâtürîdî (ö. 333/944, Mâverdî (ö. 450/1058), Tûsî (ö. 460/1067), İbnü’l-Arabî (ö. 543/1148) ve İbn Kesîr (ö. 774/1373) gibi Sünnî ve Şiî müfessirlerden önce Ebû Bekir el-Esam (ö. 200/816), Ebû Alî el-Cübbâî (ö. 303/916) ve Ebû Müslim el-İsfahânî (ö. 322/934) gibi Mu‘tezilî isimler tarafından isrâiliyyât eleştirisinin yapıldığı görülmektedir. Her ne kadar onlar eserlerinde isrâiliyyât kavramını kullanmasalar da bu eleştirileri bazen rivayetlerin kaynağına bazen de içeriğine yöneltmektedir. Daha sonraki Mu‘tezilî âlimlerin de belli âyetler üzerinden bu eleştiriyi sistematik olarak devam ettirdikleri söylenebilir. Çalışmada öncelikle hicrî 2-6. asırda yaşamış el-Esam, Ebû Ali el-Cübbâî, Ebû Müslim el-İsfahânî, Kâdî Abdülcebbâr (ö. 415/1025), Cüşemî (ö. 494/1101) ve Zemahşerî (ö. 538/1144) gibi müfessirlerin, israiliyata bakışına odaklanılmaktadır. Söz konusu müfessirlerin farklı israilî rivayetler karşısındaki tutumu betimsel analiz yöntemiyle değerlendirilmektedir. Ayrıca aynı dönemdeki Sünnî müfessirlerin bu rivayetlere yaklaşımına da atıfta bulunulmaktadır. Mu‘tezilî müfessirlerin isrâiliyyâta yaklaşımı ele alınırken; onların bu rivayetleri reddetmeleri, isrâilî rivayetleri yorumsuz aktarmaları, aklî yorumu isrâilî rivayetlere tercih etmeleri ve isrâiliyyâtla âyetleri tefsir etmeleri gibi farklı yaklaşımlar hususunda ayrıma gidilmektedir. Mu‘tezilî müfessirler eserlerinde birçok İsrâilî rivayet aktarsa da özellikle tefsir geleneğinde sorunlu bazı rivayetlerin te’vilinde eleştirel yaklaşımın ilk örneklerinin onlardan gelen tefsirlerde olduğu söylenebilir. Bu bağlamda çalışmada klasik dönemde isrâiliyyat eleştirisinde Mu‘tezilî müfessirlerin öncü olduğu, özellikle ismet-i enbiyâ ve ismet-i melâike ile ilgili bir takım rivayetlerin eleştirisinin ilk önce Mu‘tezilî müfessirlerle başladığı sonucuna ulaşılmıştır. Yine Mâtürîdî, Mâverdî ve Tûsî gibi Sünnî ve Şiî müfessirlerin kimi yerlerde söz konusu rivayetleri eleştirirken Mu‘tezilî isimlere referansta bulunmasına da dikkat çekilmiştir. Son olarak Mu‘tezilî müfessirler, küllî bir isrâiliyyât eleştirisi yapmasalar da bazı yerlerde söz konusu rivayetleri “Yahudi uydurması ve Tevrat kaynaklı” olarak tanımlamaktadırlar. Bu da onların referans noktaları kendi kelâmî anlayışları olmakla birlikte rivayetleri kaynak açısından da eleştirdiklerini ortaya koymaktadır. Nitekim sistematik bir isrâiliyyât münekkidi olan İbn Kesîr de Peygamberlerin ismetiyle bağdaşmayan kimi rivayetlere tefsirinde yer vermeksizin reddettiği görülürken mucizevî olayları abartılı şekilde resmeden bazı isrâilî rivayetleri yorumsuz aktarmaktadır. ................English....................... The purpose of this study is to reveal university students’ perceptions regarding Holy Qur’an through metaphors. The survey group of study consists of 194 participants who were studying in Theology Department and Social Service Department at Gümüşhane University in the 2014-2015 academic terms. Both quantitative and qualitative methods are used together. The study’s data was collected through a form with the phrase “The Holy Qur’an is similar/like…, because...” and some demographical variables. The Content Analysis Technique was used to interpret (...) data. Results of this study determined that 44 different metaphors regarding Holy Qur’an were given by participants. Theme of these metaphors were compiled as 9 categories consisting of directional, life source, explanatory, key, protective, curative, instructive, speech, and other categories. Top metaphors are in the directional, life source and explanatory categories. Key words are metaphor, perception, The Qur’an perception, religious concepts, and religious symbols. Getting data through comprehensive and in-dept analysis can help to have information about concepts of holy books in the human mind. The purpose of this study is to pick out perceptions of university students with regard to the Holy Qur’an through metaphors. For this reason, these questions are searched by researchers: 1) What are the metaphors which used by university students on description of perceptions regarding the Holy Qur’an? 2) How are the metaphors regarding the Holy Qur’an categorized in terms of common characteristics which produced by university students? 3) Are there any links between socio-demographic variables and composed metaphoric categories? One of the qualitative data collection technics, data collecting through metaphors method is used, and is asked open-ended question in the study. Picking up similarities and diversities under thematic topics is quite easy in the method. Therefore, this method has a functional feature in the sociology, psychology and anthropology, and it gives a wealthy and qualified image about matter, phenomenon, event and situation (Yıldırım & Şimşek 2005, 212). The target population of the study consists of students who were taking education at Gümüşhane University. Easily accessible and availability principles pursued in the sample choosing. In the distribution of participants according to the demographical features, females have 61.9 percent (n:120) and males have 38.1 percent (n:74) in terms of gender. Students who graduated from religious vocational high school is 61.3 percent (n:119), and others who from other high schools is 38.7 percent (n:75) in terms of graduated from different high schools. Students in theology department have 68.0 percent (n:132), and students who were educated in the social service department have 32.0 percent (n:62). Research data is gathered through survey form includes “The Holy Qur’an is like/similar to…, because…” sentence and demographical variabilities. Data, gathered from 194 survey forms, is transferred to the Excel and the SPSS program. In an attempt to reliability of study, gathered metaphors is examined by four area expert. Frequencies (f) and percentages (%) is taken into consideration in the process of replacing metaphors to the tables. Data analysis technique is used on the getting relationships and explaining gathered data, while content analysis technique is used on the interpreting of data. The SPSS program is used in the analysis of quantitative data. Obtained data from the surveys and composed categories is associated with descriptive statements in the verses of the Holy Qur’an. In the composed categories demonstrate distribution of produced 44 different metaphors with regard to the Holy Qur’an as 9 categories. According to this, the sample is represented in the categories as 64.4 % (f:125) is in the ‘directional’, 11.3 % (f:22) is in the ‘life source’, 7.7 % (f:15) is in the ‘explanatory’, 3.1 % (f:6) is in the ‘key’, 3.1 % (f:6) is in the ‘protective’, 2.1 % (f:4) is in the ‘curative’, 2.1 % (f:4) is in the ‘instructive’, 2.1 % (f:4) is in the ‘speech’ and 4.1 % (f:8) is in the ‘other’ categories. Distributions of composed categories are represented according to common characteristics as frequencies and percentages in the next tables. In the distribution of produced metaphors in the ‘directional’ category, university students produced 7 different metaphors (f:125). Frequencies of produced metaphors in the category are such that: guide (f:41), advisor (f:25), mentor (f:19), compass (f:16), road map (f:8), route (f:3) and other (f:13). According to the result, it is understood that aspects of guide, advisor, mentor and compass stood mostly out in the category. In the ‘life source’ category, 6 different metaphors (f:22) is developed by participants. Developed metaphors’ frequencies in the category are the following: life (f:4), lifeblood (f:4), weather (f:2), water (f:2), inheritance (f:2) and others (f:7). So, life and lifeblood aspects stood mostly out in the category. In the ‘explanatory’ category, 5 different metaphor (f:15) is developed by participants. Frequencies of produced metaphors in the category are such that: light (f:5), sun (f:3), flashlight (f:2), torch (f:2) and other (f:3). According to the result, it is understood that aspects of light and sun stood mostly out in the category In the ‘protective’ category, 5 different metaphors (f:6) is developed by participants. Frequencies of produced metaphors in the category are such that: saver (f:2), lifeguard (f:1), hereafter-saving (f:1), escapeway (f:1) and branch to catch (f:1). According to the result, it is understood that aspect of saver stood mostly out in the category. In the ‘instructive’ category, 4 different metaphors (f:6) is developed by participants. Frequencies of produced metaphors in the category are such that: reference book (f:1), dictionary (f:1), priceless book (f:1) and life encyclopedia (f:1). In the ‘speech’ category, it is seen that 4 different metaphors (f:6) is developed by participants. Frequencies of produced metaphors in the category are such that: divine message (f:1), speaking truth (f:1), Allah’s dialogue with us (f:1) and final word (f:1). In the ‘key’ category, 3 different metaphors (f:6) is developed by participants. Frequencies of produced metaphors in the category are such that: a key (f:4), the key of heaven (f:1) and the key of salvation (f:1). In the ‘curative’ category, 2 different metaphors (f:4) is developed by participants. Frequencies of produced metaphors in the category are such that: a pill (f:3) and doctor (f:1). In the ‘others’ category, 8 different metaphors (f:8) is developed by participants. Frequencies of produced metaphors in the category are such that: world (f:1), the friend of lonely passenger (f:1), the tree with fruit (f:1), hereafter (f:1), priceless treasure (f:1), miracle (f:1), philosophy (f:1) and mirror (f:1). Participants composed of 44 different metaphors regarding the Holy Qur’an. The metaphors were summed up in the 9 categories as ‘directional’, ‘life source’, ‘explanatory’, ‘key’, ‘protective’, ‘curative’, ‘instructive’, ‘speech’ and ‘other’ To results of the study; guide, advisor, mentor and compass aspects of the Qur’an came into prominence at most in the ‘directional’ category, when life and lifeblood aspects of the Qur’an came into prominence at most in the ‘life source’ category. Light and sunny aspects of the Qur’an came into prominence at most in the ‘explanatory’ category, while saver aspect of the Qur’an came into prominence at most in the ‘protective’ category. Instructive aspect of the Qur’an came into prominence at most in the ‘instructive’ category. Speech aspect of the Qur’an came into prominence at most in the ‘speech’ category, while key aspect of the Qur’an came into prominence at most in the ‘key’ category. Moreover, pill aspect of the Qur’an came into prominence at most in the ‘curative’ category. Whatsoever world, friend of single traveler, tree with fruit, hereafter, priceless treasure, miracle, philosophy and mirror aspects of the Qur’an came into prominence at most in the ‘other’ category. It is inferred that significant relationships between demographic variables and metaphor categories. In terms of major variable; theology students were composed of more metaphor in the ‘explanatory’ and ‘instructive’ categories, while social service students were composed of more metaphor in the ‘life source’ category. In terms of gender variable; females composed of more metaphor in the ‘curative’ and ‘other’ categories, while males composed of more metaphor in the ‘directional category. In terms of graduating high school variable, students who graduated from religious vocational high school composed of more metaphor in the ‘key’ and ‘speech’ categories, when students who graduated from other high school composed of more metaphor in the ‘directional’ category. Whatsoever, in terms of having the Qur’an education in their life status variable, had the Qur’an education in their life students composed of more metaphor in the ‘curative’ and ‘other’ categories, while other group composed of more metaphor in the ‘directional’. Moreover, in terms of perception of subjective religiousness, students who think themselves are ‘religious’ composed of more metaphor in the ‘key’ and ‘other’ categories, while students who think themselves are ‘less religious’ composed of more metaphor in the ‘explanatory’ category. In terms of perception of family religiousness, students who think own family ‘less religious’ composed of more metaphor in the ‘directional’ and ‘life source’ categories, when students who think own family ‘religious’ composed of more metaphor in the ‘key’ category. It can be suggested by the results of this study; perception of the Qur’an can be studied with the different study techniques, or it can be studied in the different research groups with the same technique. Muslims’ perceptions regarding the Holy Qur’an can be examined with intercultural comparative studies. Perceptions regarding the Holy Qur’an can be researched through interviews. Members’ perception regarding holy book that have different religious faith can be comparatively examined. Individuals’ perceptions regarding different religious concepts can be studied through metaphors. .................. Turkish...................Bu araştırmanın amacı üniversite öğrencilerinin Kur’an-ı Kerim’e ilişkin algılarını metaforlar aracılığıyla ortaya çıkarmaktır. Araştırmanın çalışma grubunu, 2014-2015 eğitim öğretim yılında Gümüşhane Üniversitesi İlahiyat Fakültesi ve Sosyal Hizmetler bölümünde öğrenim gören 194 katılımcı oluşturmaktadır. Araştırmada nitel ve nicel yöntemler birlikte kullanılmıştır. Araştırma verileri, “Kur’an-ı Kerim……gibidir, çünkü……” cümlesini ve demografik değişkenleri içeren bir form aracılığıyla toplanmıştır. Verilerin analizi ve yorumlanmasında içerik analizi tekniği kullanılmıştır. Araştırmada Kur’an’a ilişkin 44 farklı metafor geliştirildiği tespit edilmiştir. Bu metaforlardan ‘yönlendirici’, ‘yaşam kaynağı’, ‘açıklayıcı’, ‘anahtar’, ‘koruyucu’, ‘öğretici’, ‘derman’, ‘kelam’ ve ‘diğer’ olmak üzere 9 farklı kategori oluşturulmuştur. Üretilen metaforların ‘yönlendirici’, ‘yaşam kaynağı’ ve ‘açıklayıcı’ kategorilerinde yoğunlaştığı görülmüştür. Demografik değişkenler ile metafor kategorileri arasındaki ilişkiyi ortaya çıkarmak araştırmanın ikincil amaçlarındandır ve bu yönüyle sonuçlar değerlendirildiğinde değişkenler ile kategoriler arasında anlamlı ilişkiler olduğu tespit edilmiştir. Demografik değişkenler ile kategori ilişkisinde fakülte değişkeni açısından ilahiyat öğrencileri ‘açıklayıcı’ ve ‘öğretici’ kategorilerinde daha fazla metafor üretirken sosyal hizmet öğrencileri ‘yaşam kaynağı’ kategorisinde daha fazla metafor üretmiştir. Cinsiyet değişkeni açısından ise kız öğrenciler ‘derman’ ve ‘diğer’ kategorilerinde daha fazla metafor üretirken erkek öğrenciler ‘yönlendirici’ kategorisinde daha fazla metafor üretmiştir. Lise mezuniyeti açısından bakıldığında da İHL’den mezun olanlar ‘anahtar’ ve ‘kelam’ kategorilerinde daha fazla metafor üretirken diğer lise mezunları ‘yönlendirici’ kategorisinde daha fazla metafor üretmiştir. Kur’an Kursu eğitimi alma değişkeni açısından ise Kur’an kursu eğitimi alanlar ‘derman’ ve ‘diğer’ kategorilerinde daha fazla metafor üretirken Kur’an Kursu eğitimi almayanlar ‘yönlendirici’ kategorisinde daha fazla metafor üretmiştir. Human actions have been one of the most discussed topics in the science of kalām since the first centuries of Hijra. Many scholars from different schools of kalām have tried to solve this problem. Efforts to solve the problem have brought different views. In this framework, three main views emerged Jabrī, Qadarī/Muʿtazilī and Salafī/Sunnī. The views of Islamic philosophers were added to these and this number was increased to four. Nevertheless, Sunnī scholars, who agree on the basic propositions, disagreed on (...) the nature of kasb. While there are differences of opinion between Ashʿarī and Māturīdī schools, there are also those who put forward different views among scholars belonging to the same school. Abū Bakr al-Bāqillānī (d. 403/1013), Abū Isḥāq al-Isfarāyīnī (d. 418/1027) and Juwaynī (d. 478/1085), Sadr al- Shrīʿa (d. 747/1346) and Ibn al-Humām (d. 861/1457) are the most obvious examples of this. These views on human actions have been mentioned in their works by scholars of kalām. One of these scholars is Gelenbevî Ismāʿil (d. 1205/1791). In this article, the views on human actions will be examined in the context of Gelenbevî’s work named Ḥāshiya ʿalā Sharḥ al ʿAqāʾid al ʿAḍudiyya. Gelenbevî makes concise or detailed explanations about the views mentioned in his work with the exception of Ibn al-Humām. In addition, he also mentions the views of al-Ghazālī (d. 505/1111). While Gelenbevî mentions these views and the discussions that took place around them, He makes use of his works Ījī’s (d. 756/1355) named Mawāqif, Taftāzānī’s (d. 792/1390) Sharḥ al Maqāṣ̣ıd and Jurjānī’s (d. 816/1413) Sharḥ al - Mawāqif. Gelenbevî states that Ashʿari’s view is middle jabr (jabr al muṭavaṣṣıṭ) and even he is accused of being pure jabr (jabr al- maḫẓ). Based on the concept of partial will (al-irādah al-juzʾiyyah), he says that the views of Bāqillānī and Māturīdī school are the same and states that this view is more successful than Ashʿari’s in explaining human responsibility. This thought indicates that he is closer to the Māturīdī view of human actions than to Ashʿarī. He points out that Isfarāyīnī’s views are open to criticism in some respects. He implicitly states that he does not agree with the idea that Juwayni agrees with the Islamic philosophers. Rather than Muʿtazila’s views, it focuses on whether their views and the views of Islamic philosophers are the same. (shrink)

The roots of the formation of a post-Mongol political theology that situated Muslim emperors and sultans at the center of an Islamic cosmos are found in the Ilkhanid court in late thirteenth- and early fourteenth-century Iran. This article investigates the case of the short-lived rebellion of the Mongol governor of Rūm and Mahdi-claimant Temürtash. It demonstrates how the discourse of religious reform was recruited to translate and support the claims of non-Chinggisid commanders to the transfer of God’s favor, thus opposing (...) the Chinggisids’ heaven-derived exceptionalism. Exploring affinities with the Timurid appropriation of the mujaddid tradition a century later, the article argues that Temürtash’s rebellion signaled the early stages of the dispersion of a new political language that freed Muslim kingship from the restrictive genealogical and juridical Sunni models of authority. Kelime olarak ‘öncekiler’ anlamında selef kökünden türetilen Salafism, ‘öncekilerin izini takip edenlerin yolu’ demektir ve bir tür dinsel tutuculuk ve muhafazakârlık anlamına gelmektedir. İslam geleneğinde Islamic tenetlara katı ve literal bağlılığı ve dinin saf asıllarına dönüşü ifade eden Salafism, günümüzde İslami ilimler, siyaset bilimi ve uluslararası ilişkiler gibi alanlarda dinsel radikalizm ve köktencilikle eşanlamlı olarak kullanılmaktadır. Geleneksel formuyla, dinsel akılcılığa ve yorum yanlısı olmaya karşı bir duruş üzerinden kendini kuran Salafism, din içi çoğulculuğa ve sekülerizme karşı öze dönüşcü bir tepkiyi (...) temsil etmektedir. Dinin özüne dönüşü savunan Salafi paradigma, Müslüman medeniyetinin düşünsel ve sanatsal başarı ve ürünlerine de kuşkuyla bakar, bu yönüyle de kültür karşıtı bir tutumu temsil eder. Selefi eylemci grupların İslam medeniyetine ve diğer kültürlere verdikleri zarar bunun somut örneklerini oluşturmaktadır. Bu çalışma modern zamanlarda Salafism parlamasına yol açan nedenler üzerinde yoğunlaşmaktadır. Çalışmada, toplumsal değişim, modernleşme ve sekülerleşme karşısında hangi dinsel ve toplumsal kaygıları temsil ettiği analiz edilmektedir. Salafismin Sünnilik ile ilişkisi incelenmekte ve onu Sünnîliğin dışında göstermeye çalışan yaklaşımların yanıltıcı yanlarını vurgulamaktadır. Disiplinler arası yaklaşımla konuyu ele alan çalışma, teoloji ile siyaset bilimi ve uluslararası ilişkilerin kesişme alanında analizler içermektedir. Selefilik ile ilgili kavramsal analizler, bu kavramın İslam öncesi köklerini ortaya koymaktadır. Aslında her toplumda rastlanan ve geçmiş bir öz atfetme ve bugünü yönetme ihtiyacı Araplarda ‘ataların yoluna tâbi olma’ şeklinde belirir. Geçmişin kutsanması, yeniliklerden ve farklılıklardan kuşku duymayı doğurur. Selefîlik tarafından temsil edilen ‘İslamî özcülük’ değişime karşı sabitliği, çoğulculuğa karşı özcülüğü, akla karşı nassı, ibtida yerine ittiba’yı savunur. Dinî konularda katı nassçı ve literal tutumu benimsediği için kelam, felsefe ve tasavvufu dinden uzaklaşma sayar. Tarihe bakışta kötüye gidiş, özden uzaklaşma ve çürüme düşüncesine bağlıdır. Modern dönemlerde İslam dünyası çok yönlü bir kriz ve çöküş yaşamıştır. Siyasal alanda başlayan sorunlar kimlik ve değerler alanına doğru genişlemiştir. Kimliği, özü ve inancı koruma kaygıları radikal bir tutuculuk olarak selefiliği beslemiştir. Krizlerin artarak devam ettiği İslam dünyasında Selefilik bir düşünce, inanç, yaşam tarzı ve eylem türü olarak ilgi çekmektedir. Ancak yaşanabilir bir alternatif üretmek yerine tepkisel bir duruşu temsil etmekte, minimal ve sert bir dinî yaşantıyı savunmaktadır. Ayrıca kültüre ve sanata yönelik sert yaklaşımı, İslam medeniyeti açısından nihilist bir bakışı ifade etmektedir. Sünnî dünyada Selefilik ile ilgili bir kafa karışıklığı göze çarpmaktadır. Bu karışıklık tarihsel ve teolojik olarak selefiliğin Sünnilik tarafından benimsenmesi ile ilgilidir. Oysa güçlenen yeni Selefilik mevcut Sünnî kimliğini oluşturan unsurları reddetmektedir. Bu Sünnilik açısından kriz içeren bir durumdur. Kelam, fıkıh ve tasavvuf bilgisine dayalı kapsayıcı Sünnilik ile katı nasscı ve dışlayıcı Selefilik arasındaki teolojik gerilim hala devam etmektedir. AimsThis study evaluates a protocol for early, routine ethics consultation for patients on extracorporeal membrane oxygenation to support decision-making in the context of clinical uncertainty with the aim of mitigating ethical conflict and moral distress.MethodsWe conducted a single-site qualitative analysis of EC documentation for all patients receiving ECMO support from 15 August 2018 to 15 May 2019. Detailed analysis of 20 ethically complex cases with protracted ethics involvement identifies four key ethical domains: limits of prognostication, bridge to nowhere, burden of (...) treatment and system-level concerns. There are three subthemes: relevant contextual factors, the role of EC and observed outcomes. Content analysis of transcripts from interviews with 20 members of the multidisciplinary ECMO team yields supplemental data on providers’ perceptions of the impact of the early intervention protocol.ResultsLimited outcome data for ECMO, unclear indications for withdrawal, adverse effects of treatment and an obligation to attend to programme metrics present significant ethical challenges in the care of this patient population. Upstream EC mitigates ethical conflict by setting clear expectations about ECMO as a time limited trial, promoting consistent messaging among multiple services and supporting surrogate decision-makers. When ECMO becomes a ‘bridge to nowhere’, EC facilitates decision-making that respects patient values yet successfully sets limits on non-beneficial use of this novel therapy.ConclusionData from this study support the conclusion that ECMO poses unique ethical challenges that necessitate a standardised protocol for early, routine EC—at least while this medical technology is in its nascent stages. Millions of domestic workers in Indonesia are a source of livelihood for those in the lower middle class. Sadly, protection for domestic workers has yet to be adequately implemented. It has sparked debate among human rights activists and other human rights groups who hope a particular law will protect domestic workers. It means that legal transformation is needed. This research was conducted to conduct a juridical analysis of what legal transformation model would be appropriate for domestic workers in Indonesia by (...) conducting a comparative test with the case of domestic workers in Hong Kong. The research results show that from the start, Indonesia must clarify the status of domestic workers as one of the elements of workers in Indonesia and create a Lex Specialist for domestic workers. At the same time, Indonesia also needs to take lessons from Hong Kong regarding the importance of an independent body to supervise law enforcement to protect domestic workers because the formation of a law without a sound law enforcement system means the expected results will not be by the vision and mission when forming the law. Türk ve İslam tarihinin kırılma noktalarından birisi 1040 yılında Selçuklular ile Gazneliler arasında cereyan eden Dandanakan Savaşı’dır. Savaşın ardından Selçuklular hızlı bir yükselişle özellikle Sünnî İslam coğrafyasında etkin ve belirleyici güç haline gelmiştir. Göçebe kültürden gelen ve bir oba hüviyetinde iken çok kısa bir sürede önlenemez bir şekilde hâkimiyet alanını Türkistan coğrafyasından Anadolu içlerine kadar genişleten Büyük Selçuklu Devleti, kurumsal olarak da olgunlaşmaya başlamıştır. Bu noktada hem merkezi yönetimde hem de vilayetlerde ortaya çıkan yetişmiş eleman ihtiyacını birçoğu daha önce Gazneli (...) devlet teşkilatında görev yapmış Fars asıllı devlet adamları karşılamıştır. Bu isimlerden birisi de ileride Nizâmülmülk adıyla şöhret bulacak ve namı isminin önüne geçecek olan Hasan b. Alî b. İshâk et-Tûsî’dir. Nizâmülmülk, devlet gücünün askeri alanda elde edilen zaferlere endekslendiği bir dönemde askerî, idarî, ilmî ve ekonomik alanda attığı adımlar ve aldığı tedbirlerle Büyük Selçuklu Devleti’nin kurumsallaşmasında son derece etkin bir isim olmuştur. Bu etkinlik neticesinde hem halk hem de devlet adamları nezdinde saygın bir yer edinmiştir. Bu çalışma çerçevesinde Nizâmülmülk’ün devlet bürokrasisi içerisindeki konumuna, hükümdar ve hanedan üyeleri ile olan ilişkilerine ve vezirlik sürecinde attığı adımların Selçuklu tarihine yansımalarına değinilecektir. Özet: Devlet kademesinde görev almaya Gazneliler Devleti’nin Horasan Valisi Ebü’l-Fazl Sûrî’nin yanında başlayan Nizâmülmülk, Horasan Bölgesi’nin Selçukluların kontrolüne geçmesiyle birlikte hizmetlerine Selçuklu Devleti’nde devam etmiştir. Çağrı Bey’in hizmetinde rüştünü ispat eden Nizâmülmülk, Çağrı Bey’in en güvendiği isimlerden biri haline gelmiştir. Öyle ki, Çağrı Bey ileride önce Horasan’ın sonrasında tüm Selçuklu yurdunun yönetimini üstlenecek olan oğlu Alparslan’ı Nizâmülmülk’e emanet etmiş, oğluna da Nizâmülmülk’ü bir baba olarak kabul etmesini, ona muhalefet etmemesini öğütlemiştir. Alparslan, babasının tavsiyeleri ve üvey kardeşi Süleyman ile giriştiği taht mücadelesinde gösterdiği yararlılık münasebetiyle devletin en önemli idari görevi olan vezirlik makamını Nizâmülmülk’e tevdi etmiştir. Bu dönemden itibaren vefatına kadar, yaklaşık 30 yıl kesintisiz bir süreyle Büyük Selçuklu Devleti’nin vezirliğini yapmış ve V./XI. yy.’ın ikinci yarısından itibaren Büyük Selçuklu siyasetinin en etkin figürü haline gelmiştir. Melikşah’ın tahta geçebilmesinin Nizâmülmülk ile ilişkilendirilmesi, onun döneminde elde edilen başarıların ve devlet sisteminin düzenlenmesi, şehirlerin imarı, ekonominin güçlenmesi gibi ülke içerisinde yaşanan olumlu gelişmelerin Nizâmülmülk’ün marifetiyle gerçekleştirildiğinin dillendirilmesi, Tanrı tarafından yeryüzünü yönetmek ve inşa etmek için seçildiği düşünülen bir sultan varken bir vezirin devlet için nimet olarak gösterilmesi sultanın vezirine bakışını etkilemiştir. Bu noktada üzerinde durulması gereken hususlardan birisi de Nizâmülmülk’ün kendisini nasıl gördüğü ve devlet içerisinde kendini nerede konumlandırdığıdır. Nizâmülmülk’ün Sultan Melikşah’a verdiği bir cevapta devletin geldiği noktayı ve sultanın mevcudiyetini kendi varlığıyla eşleştirmesi, tarihinin gördüğü en yetenekli vezirlerden biri olan Nizâmülmülk’ün özgüveninin son derece yüksek ve kendisini kudret sahibi olarak gördüğüne işaret etmektedir. Bu anlamlandırma halk nezdinde herhangi bir kutsiyeti bulunmayan vezirlik makamındaki bir kişinin, toplum nezdinde Allah tarafından seçildiğine inanılan kutlu kişiye meydan okutan gücü kendisinde hissetmesinin kaynağını sorgulatmaktadır. Aranan cevap Nizâmülmülk’ün vezirlik sürecinin çeşitli başlıklar altında ve bu başlıklara dair verilecek örneklerle incelenmesi neticesinde onun devletin iç işleyişine etkisinin tespitinde ve farklı kesimlerle kurduğu ilişkide saklıdır. Nizâmülmülk, Selçuklu tahtına karşı sıkı bir bağlılık göstermiştir. Bu bağlılığını lüzumu halinde savaş meydanında göğüs göğüse çarpışarak sergilemiş, gerekli olduğunda kıvrak zekâsı ile sorunları devlet için tehlikeli boyuta gelmeden çözmüş, siyasi öngörüsü ile aldığı tedbirler sayesinde devletin büyümesine katkı sağlamıştır. Onun bu sadakati ve samimiyeti, Selçuklu sultanları tarafından karşılık bırakılmamış, Alparslan vezirinin fikirlerine büyük önem verip tercihlerini bu doğrultuda şekillendirirken, aleyhine söylenen sözlerin hiçbirine kulak asmamıştır. Melikşah da, bir anlamda kendisine Selçuklu tahtını veren Nizâmülmülk’e gerekli hürmeti göstererek bütün devlet işlerinin yürütülmesini ona tevdi etmiş ve kendisini bir “baba” gibi gördüğünü ifade etmiştir. İlaveten Selçuklu tarihinde bir ilk olmak üzere Melikşah, Nizâmülmülk’e atabeg (el-emîrü’l-vâlid) unvanını vermiştir. Melikşah, Büyük Selçuklu tahtındaki ilk yıllarını, gençliğin etkisiyle, polo oynayıp, büyük av partileri düzenlemekle geçirmiş ve bundan dolayı devlet içerisinde bütün güç Nizâmülmülk’ün eline geçmiştir. Ortaya çıkan bu durum da “ülke resmen ve ismen sultanın olmakla birlikte gerçekte ‘Nizam’ına kavuştu.” ifadesiyle açıklanmıştır. Ayrıca Melikşah’ın saltanatı döneminde elde edilen askerî, siyasî ve ekonomik başarılar Nizâmülmülk’ün yeteneği ve devlet işlerinde attığı adımlara bağlanmıştır. Nizâmülmülk, hanedan ile kurduğu ilişkinin yanı sıra devlet kademesinde görev alan farklı zümrelerle de güven üzerine dayalı yakın bir ilişki biçimi geliştirmiştir. Örneğin, Nizâmülmülk’ün katıldığı askerî seferlerde bir nefer gibi askerlerin içerisinde savaşa katılması ordu içerisinde kendisine saygı duyulmasına yol açmıştır. Ayrıca, Melikşah ile Kirman Hâkimi Kavurd Bey arasındaki taht mücadelesinde Melikşah’ın safında yer almakla birlikte Kavurd Bey’i destekleyen bazı isimlerin yazdıkları destek mektuplarının ortaya çıkmasına engel olarak hem emirlerin korkularını yatıştırırmış hem de itibarını artırmıştır. Nizâmülmülk’ün yakın ilişki içerisinde olduğu bir diğer grup ilmiye sınıfı olmuştur. Bilge vezir, Tuğrul Bey döneminde Amidülmülk Kündürî tarafından takibata uğrayan ve baskılara maruz kalan ilim adamlarının yurtlarına dönebilmelerine imkân sağlamıştır. Bu ilim adamları da yurtlarına dönüşlerini sağlayan isme zihinlerinde ve gönüllerinde her zaman özel bir yer ayırmışlardır. Birçok âlimin çalışmalarını Nizâmülmülk’e ithaf etmesi, diğer saiklerle birlikte, bunun bir göstergesidir. Nizâmülmülk bir adım daha atarak, Sultan Alparslan ve Melikşah’ın müsaadeleriyle, bu ilim adamları için hâkim olunan coğrafyanın her tarafında ilimle iştigal edebilecekleri medreseler inşa etmiştir. Nizâmülmülk’ün adına nispetle Nizamiye Medreseleri olarak isimlendirilen bu medreselerde hem eğitim-öğretim kadrosuna hem de öğrenim süresi boyunca ve de mezun olduktan sonra öğrencilere sunulan imkânlar, insanların medreselere olan ilgisini arttırıyordu. Medreseler eliyle bir taraftan önceki dönemde yerlerinden edilen ve baskıya maruz kalan ilim adamlarına bir borç ödenip iade-i itibar sağlanırken diğer taraftan da Büyük Selçuklu Devleti’nin idari ve adli sisteminin ihtiyaç duyduğu yetişmiş insan gücü inşa edilmiştir. Nizâmülmülk, toplum lehine attığı adımlar ve sorunların çözümüne verdiği önem ile halkın desteğini sağlamıştır. Öyle ki insanların hayatları boyunca ona minnettar kaldığı vurgulanmıştır. Nizâmülmülk halkın sorunlarının çözümüne önem göstermiş ve onlarla yakından ilgilenmiştir. Nizâmülmülk’ün verdiği güven duygusu halkın hoşuna gitmiş ve toplum içerisinde kabul görmesine vesile olmuştur. Nizâmülmülk’ün bir diğer hasleti de fakirlere sofrasını açmasıdır. Böylece onlarla diyalog kurmuş ve gönüllerini kazanmıştır. Her yönüyle eksiksiz bir devlet adamı olan Nizâmülmülk, toplumun her türlü ihtiyacının çözümünü düşünmüş ve bu yönde adımlar atmıştır. Nizâmülmülk’ün toplumun her kesimi ile kurduğu samimi ve yakın ilişki o kadar büyük bir takdir ve beğeni toplamıştır ki bu durum Nizâmülmülk’ün toplum nezdinde sultan itibarı görmesine sebep olmuştur. İlaveten Selçuklu coğrafyasının her yerinden ve toplumun her kesiminden insanın kendisine yönelmesi hasebiyle Kâbe’ye benzetilmiştir. Nizâmülmülk, devlet kademesinde görev alan aile bireyleri, ilişki içerisinde olduğu âlimler, kendi ordusu ve emirleri ile bir güç odağı haline gelmiştir. Bunun sonucunda Nizâmülmülk, 11. yüzyılın son çeyreğinde rakipsiz bir şekilde Büyük Selçuklu siyasetinin en etkin figürü, Selçuklu yönetimini ve politikalarını belirleyen isim ve Selçuklu tarihinin en önemli olaylarında karar mercii olmuş ve sonuçta Selçuklu tarihine damga vurmuştur. İbnü’l-Esîr, Fatımî veziri Bedr el-Cemalî’nin kendisi için kullandığı sayısız lakabı kaydettikten sonra sadece Mısır’a hâkim olan bir devletin veziri bu kadar lakap kullanıyorsa Nizâmülmülk’ün “ilah”lık iddiasında bulunması gerekirdi diyerek hem Selçuklunun azametini hem de Selçuklu devletinde Nizâmülmülk’ün yerini göstermektedir. I take it as my assignment to criticize the Gauthier enterprise. At the outset, however, I should express my general agreement with David Gauthier's normative vision of a liberal social order, including the place that individual principles of morality hold in such an order. Whether the enterprise is, ultimately, judged to have succeeded or to have failed depends on the standards applied. Considered as a coherent grounding of such a social order in the rational choice behavior of persons, the enterprise (...) fails. Considered as an extended argument implying that persons should adopt the moral stance embodied in the Gauthier structure, the enterprise is, I dunk, largely successful. Considered as a set of empirically falsifiable propositions suggesting that persons do, indeed, choose as the Gauthier precepts dictate, the enterprise offers Humean hope rather than Hobbesian despair.
